Transfer to daughter not complete... trip coming up... advice, please

Hello all,

Many of you may remember that we purchased DVC memberships to give to both our daughter and our son upon their graduation. DD graduated in August and we presented her with 110 BWV points. We then started the process to try to officially transfer the points to her name. It took three requests to get the form sent by DVC and then we went through the grief of trying to get it all filled out between two states (DD lives in Georgia and we live in Louisiana). We then sent off the form to Disney for ROFR. Well.... somewhere along the way, the form mysteriously disappeared and Disney has no record of it. Yes, we can send the form in all over again... but the major frustration at this point is that we have a trip fast approaching using our BLT points (now just two weeks away). Our original plan had been that we would purchase DD and DSon-in-law's tickets with THEIR DVC membership cards, which should have been acquired long before now if everything had flowed smoothly. I didn't panic about it before now because I was woefully uninformed about how much Magic Your Way tickets had gone up in price (we've had APs for quite a long time). Now that the original plans have gone awry and I know how ridiculously expensive the MYW tickets are, panic has set in!!! I am wondering if there is a way to either (1) expedite the transfer of ownership much quicker somehow, or (2) add their name and address to the appropriate BWV contract prior to the title actually transferring. Any advice would be greatly appreciated.

Unfortunately, I don't know how you could get anything done within that time frame. Unless they are owners of the contract, they are not yet eligible for the DVC discount.

I would think that the process for just adding them as owners and transfering the contract to them would be the same so if your original plan can not be completed in that time frame, I don't think anything else can.
 
You do realize that not only is there the Disney paperwork but also a deed has to be filed with the county? All Disney does is approve the transfer (the whole ROFR). When I transferred my title into the name of my trust I used a local title company. I got the name from my guide. It did take a couple of months but they handled everything.

Highly doubtful this could be resolved in two weeks time. You might want to check Undercover Tourist on the internet as many use this site to purchase tickets. Our Theme Parks Board will also have lots of information on the best ways to buy tickets. They can then purchase AP's as DVC Members the next time a trip comes up for them.
 

Thanks for the replies. It shouldn't take several months for the transaction to be completed since it is between family members. I had originally been told by Disney that it would only take about a month... and that was when we first submitted the form several months ago. If it hadn't been "lost" on the Disney end, then we would have had plenty of time. We had hoped to have it back in time to file the deed ourselves in Orange County when we were down at Disney last month. When it's a gift between family members, using a title company or hiring someone to file the paperwork for you really isn't necessary. The only factor of the transaction that has to be handled by others is the ROFR from Disney, and unfortunately, that is where the snafu has happened.

As for purchasing tickets, the AAA discount is better than the price offered at Undercover Tourist... so if we purchase tickets for them, that's probably the route we'll go. All in all, the whole situation is frustrating. I'm hoping that since I sent the paperwork with delivery confirmation, perhaps I can get someone at Disney to intervene and expedite things. It's a HUGE price difference due to an error on their end, and it seems grossly unfair that we should have to pay the penalty.

Make certain you're comparing apples to apples. Undercover Tourist prices include tax. I believe AAA quotes just ticket prices and then adds the tax. Just an FYI that sometimes catches people.

But, I think the ROFR is not the last step - the deed will have to be retitled with FL before the ownership is changed over. So, I don't think you can do this in person and have an immediate closure until DVC is actually notified with the newly titled deed. By the time you do all this and then plead your case with DVC for the discount, well I just would not want to spend my vacation time working on this, JHMO.
 
When we transferred between family members, it still took about 6 weeks. They also canceled an upcoming trip booked with those points, even though neither party wanted them canceled.

From what I was told back in October (when we started all this), all we have to do for the transfer is get the executed Waiver of ROFR from Disney, and then file both that and the newly executed deed changing the title to Kate's name with Orange County. It's a filing fee of just $18.50 per document with Orange County if we do it in person. Then, we notify DVC Administration of the filing of the documents, along with the record numbers so they can verify the information on the OC website and they take it from there. In this way, the transaction only costs a total of $37.00 out of pocket and avoids the $350.00 fee that most companies want to charge for the service. We haven't made any reservations with this contract specifically because of the desire to avoid any snafus when the title changes... and frankly that's one of the most frustrating aspects regarding how long this process is taking. We'll have to spend $200 more on Kate and Jason's AP's AND precious time is ticking off that 11-month window for the BWV Food & Wine Festival reservations. At this rate, we'll be in the 7-month window before they can book their first trip, so any booking advantage they should have will be expended.

Here's another question though that just occurred to me. Can we purchase regular APs for them and then exchange those regularly priced APs for DVC-discounted APs once their membership cards come in? It seems like that would either net a credit for them, or perhaps some time added on to the expiration date of their regularly-priced APs. Has anyone ever tried to do this before???

Are you having a new master deed prepared, or a quit claim deed? I know the master deed takes longer, but the contract must be paid in full if doing the quit claim deed, too. The problem is that the deed recording does take time either way.

The Warranty Deed is a bit more complicated. I have taken this information from old posts here on the DIS written by folks who have gone through this in the past. You may want to do a search too. It just doesn't sound like something that you can get done in one day while on vacation and come away with a new DVC Membership card for your DD. That being said, your experience could be different. :)

Ohhh, okay... you thought I was expecting to be able to pick up her ID card while there. No, I didn't think we could get her permanent ID card while there. But, from what I've been told, it takes mere minutes to file the completed paperwork at the OC Comp office (plus $18.50 per document). The deed has already been prepared, and we'll execute it in front of witnesses down in Orlando when we go. We just have to file the deed and the Waiver while there. I was told that the OC Comp office usually processes the paperwork in 24-48 hours, so two days after we have filed the paperwork, Disney can verify the transfer. I was hopeful that at that point, they might be willing to verify the membership so that we could get the annual passes at the appropriate rate, especially since I do have delivery confirmation that Disney received our original request for the waiver over two months ago (still no word on what happened to that request).

Sounds like DVC will want a notarized copy of the new deed from you with a letter in writing, before they can change their records. Here is some good information from TUG on transferring a timeshare ownership. Hope this helps..good luck to you all! :santa:
 
I wanted to post an update on this. I FAXed another copy of the request for the Waiver of ROFR to Disney along with a note explaining that it had previously been submitted, along with the date of the previous submission. My letter explained that we had an upcoming trip and we would really appreciate if the transfer of title completed expeditiously. I also included info on our travel dates. I was contacted by one of their CMs the first business day after the FAX was sent, and the CM told me she would do her best to get the Waiver of ROFR approved and sent to me ASAP. Well, she held true to her word. The Waiver of ROFR arrived at our house via FedEx today! Of course, if we had not had the weather woes, we would actually have already been at Disney today... but they did truly make the effort to expedite things after our original submission was lost. Their effort means the WORLD to me!

I sent off the Waiver along with the Warranty Deed to the Orange County Comptroller's office today via Priority Mail. I also included a self-addressed and stamped Priority Mail envelope for the recorded documents to be returned to me. The total recording fee was $18.50 for the two-page waiver, another $18.50 for the two page deed, and $0.70 for the Deed Doc tax... for a grand total of $37.70. Priority mail there and back was about $11.50. Then, we will have to send copies of the recorded documents and one more form back to Disney... and voila, we're done. All in all, Disney has made this a pretty painless and uncomplicated process. If the original Waiver hadn't mysteriously disappeared, it would have been a total piece of cake!

Sorry to hear about the weather issue.. But, that is good news on the followup on the ROFR issue. One day I will be adding our DD's names to our contracts, too. Glad there is a more cost effective alternative!
