I think Doc or someone else can verify this for sure, but I believe the DISboards position is that rentals are between the renter and the tenant, and they don't get involved. DIS does us all a service by making the Rent/Trade board available, but they can't be the "Rental Cops."
Having said that, if you had a bad experience and reported it here, it would certainly be a big negative for the person you reported. It's often said that one of the best protections you can have in a rental is to rent from someone who has hundreds or thousands of posts here, because you know they are regulars.
We did not have a contract and anyway I feel they are basically useless anyway. Are you going to that person's state to file a lawsuit if they reneg on the contract? Contracts may be a feel good gesture, but that's about it.
I agree that contracts for hundreds of dollars are effectively unenforceable. If it makes you feel better, fine, but don't look at a contract as an ironclad protection.
However, it is
very important that both the owner renting the points and the vacationer renting points fully understand their obligations to each other, and that they know what each party will and will not do. People who rent points are very ethical, but they also have significant restrictions on what they
can do in some circumstances.
There are rules governing the use of points which limit their ability to change or cancel reservations, for example. Also, they face availability constraints. People renting points only see the risk on their side, but there is considerable risk for the owner too, so it's important for both parties to fully understand the ground rules. If that means a contract, or some written "policies," or a candid telephone conversation -- whatever works for both parties is fine. The form doesn't matter -- what matters is the understanding of the transaction.
