Tax Question - taxes taken out for the wrong state

In 2010 I received a check for back pay from my former employer, resulting from the company's bankruptcy settlement. I live in NY & worked for this company in NY, however according to the W-2 I received they took out state taxes for OH (where the company was based). How do I go about getting a refund of these OH taxes? Do I need to file a non-resident OH state tax return?
 
I am no expert, but I believe the answer is yes - if you want to get the money back. This happened to me last year as well (different states). Good luck! :)
 
Write to the company using snail mail.

Incidentally you could also file a non-resident Ohio income tax return. There is provision for declaring that you did not perform any work inside that state's boundaries in which case you would not owe any non-resident income tax.
 
Most states have a special Non-Resident Short Form for taxes withheld in error. Here is a link to the Ohio Tax information.
