I love your ring Summer, it's gorgeous!!

Is it diamonds? I think the colour of your skin underneath makes the diamonds look pink and that's soooooo pretty!! My ideal engagement ring would be pink diamonds :)
 
Thanks everyone for the compliments. Yes they are diamonds, I may have been standing under the wrong light, they are actually pretty clear stones, emerald cut in the middle and 2 radiant diamonds on the side. It sparkles so much in the sun, I still keep looking at it.:love:

Oh, and with my pictures from Randy he did give me a letter stating that i owned the copyrights to the photographs! Good thing he did too as i tried to get some printed and was asked for proof of copyright! I would just email him and ask him to include it with your pics, thats what he did with mine!

I didnt get anything from Disney, but i havent had any printed yet LOL

Thanks to all for continuing with my planning journal:thumbsup2 It makes me excited to do my TR when I come back.

Well, I spoke to my bridal salon today and she has said that my dress is scheduled to come in on August 1st. Initially she thought it would be July but this is the latest date they have suggested to her and she said it will likely be before that. I'm slightly nervous now, she said doing the alterations in 2 weeks is fine as they do them on site. She will let me know as soon as it arrives. She has ordered a larger skirt than I need as she knows I want maximum skirt:) She says it wont be a problem to just alter the waistband.
I have lost 7 pounds since I bought the dress:woohoo: so maybe doing the alterations slightly later than I anticipated may be better. This way it's just a matter of maintaining my weight before the wedding. As you can see, I still want to lose a lot more, so I am really trying my hardest now.

As most of you know I have been one of those brides that has paid a deposit on one dress and bought another. Now I really need some advice from you all...
Today my mom called the first bridal salon, one that I had paid $400 deposit to, to tell her that we are cancelling the dress. This was a dress that was bought off the rack, not made to order. Now, upon her realising I no longer wanted the dress, she is insisting that I pay the rest of it ($1000).
Now, I have not signed anything. The first time I tried on the dress I was unsure so I asked if I could go home and think about it. The next day I decided to go ahead and paid the deposit of $200 over the phone, giving her my CC details. A month and a half later, I called again and paid another $200. I then went in a week later to try it on again and noticed fake tan marks all over it. I complained there and then and she said they would dry clean it for me for $100, I wasn't happy about this as it's not like I marked the dress (why should I pay for it?). It was after that I decided to look elsewhere as I knew deep down I wasn't that thrilled with the dress in the first place.
So my mom offers to call for me while I'm at work to cancel the dress and the woman gets really nasty on the phone stating I signed a contract (lie) and that her receipt acts as a contract (she never gave me one) as all dealings with her were over the phone.
Now, I have not studied contract law yet so I am not clued up on it, but from the research I have done it doesn't seem like I owe her anything:confused3 It's not like I expect the $400 back either, I just want the dress cancelled so I can buy my dream dress, which i have now found and fallen in love with.:love: I have already paid $400 on my new dress which has been ordered for me.
So girls, what do you all think, how would you handle this?
 
hmmm, no contract, no receipt...how the heck does she think she's gonna get you to pay the rest???:confused3

and to boot, she was expecting you to pay the dry cleaning bill?!?!? I hate to sound snooty, but those marks are her problem, not yours. (this is reason enough not to purchase the dress - you don't even have to mention that its not your dream dress)

I think it is fair to let her keep the deposit as you did have a verbal contract with her. However, she has no grounds for making you pay the rest. As far as I'm concerned, you should not have to pay the difference, especially because you found it off the rack.

I purchased my dress to order and I signed a receipt, so I am def obligated to pay the difference on my dress.

If she were kind enough, she would even return the deposit since you dont' want the dress at all... but that might be asking for too much...
 
Oh Summer! There is no way you should have to pay for the first dress! That is crazy...and the drycleaning? Absurd! I can understand keeping your deposit. Maybe. But with the dress being off the rack, that is highly unusual. Like Abby said, how is she going to make you pay the rest? Don't do it.

Maybe ask one of your professors what they think...someone who teaches contract law???
 
Unless she can somehow prove that you two had a verbal contract, I don't think there's any way she can "make" you pay the balance for the first dress. You don't even have the dress at home, right? It's still in her shop? I would refuse to pay it and tell her to keep the deposit. Good luck!:hug:
 
I definately would not pay another dime for the dress. They didn't order it for you, it was in the store, and they obviously continued to use it for for "try-ons" after you paid a deposit. That would have made me go nuts!

Personally, and bear in mind I'm persnickity about these things, I not only NOT pay another dime for the dress, I'd do a chargeback on my credit card for the payments already made thanks to them continuing to use it for as a floor model after you'd agreed to buy it.

I don't blame you for going elsewhere for your dress, this shop sounds like a nightmare.

Thanks everyone for the replies. The dress is still in the shop and I have only tried it on twice. She is complaining as she has had it dry cleaned for me (at my expense, to be added to my bill when I had paid in full) I don't really know what to do. I don't think I should pay any more than I already have. She has $400 of my money that I am not asking her to return and she can still sell the dress, off the rack, like before, if anything she has made a profit:mad: I am so annoyed, I can't believe she thinks she is going to try and force me to pay it. My mom has already told her that I am not willing to pay for it, that's when she started shouting. Glad to know I'm not the only one who feels this way!
 
To be honest I would call her bluff. I am not a lawyer but I do deal with small claims court claims. As a company if we issue a claim we have to prove our out of pocket expenses.

If you have paid this lady a £200 deposit and she has had the dress cleaned at a cost of £50 then she still has £150 as a cancellation fee.

Ask her to put in writing what out of pocket expenses she has incurred in relation to the lost sale. It is not simply enough to state that she could have sold it to somebody else as she can still do that.

I would also ask for a copy of the terms and conditions with your signature showing her cancellation policy and that the deposit was non refundable.

As I understand it she has not ordered another in you were simply buying the sample off the rack.

If the dress is still on the rack why would she have had it cleaned yet? Could you get somebody to go in and check?

This is why retailers take non refundable deposits, it's tough on them but also part of business.

As a pp said if the deposit was paid via a credit card I would also point out to her that you are within you rights to query the transaction as you no longer require the dress.

Just be careful that she doesn't try and take the balance from the card you previously paid with.

Just be strong and tell her you won't be paying any more I sure that she will shout and threaten all sorts but very much doubt she will take it any further.
 
After saying over the phone that i wanted the dress, she must have put it aside. When I tried it on the 2nd time though there were loads of fake tan marks that I can't rememebr being there before as I would have seen it, they were obvious!
The thing is I know she doesn't have my signature as I only dealt with her over the phone. Do you think I should query the CC charges and claim the money back? Surely if she takes the remaining balance from the card she is commiting fraud and I can just have the charges reversed?
