I am doing this from st. louis in 3 weeks. i was about to comment on why we drive through the night, but i see you post is at 12:00am

Can you give any more details about the construction, where it starts, what are they doing, how long was it.

This way I can re route to avoid it.

If the driver is stopped in traffic, and shuts the car off, puts it in Park, and puts the keys in their lap, they should be in compliance with the law of our state.

Bad news...........
In the state of Georgia it is illegal to text and drive. If the cop sees you, he will even examine your "sent" messages to verify his observation.

All you northerners traveling south...........just a little heads up.

For the OP, sorry your overnight trip got messed up by construction.

One last thought..................I do not support texting and driving, but wanted to fill folks in on the circumstances in Georgia.

They were surfing the internet. And to be clear, a cop has ZERO right to insect your device no matter what was observed without a warrant.

I am 100% in favor of letting our cops do their jobs, but there is a limit as to what they can do.

HMMM am I a northerner Anyway it is also illegal to text while driving in Michigan. I agree the OP was probably not driving and texting. When I am at a stand still in traffic I will check my text's and send some if I have time. susan

Don't drive through Wisconsin and text. That is now illegal here also! Good think you don't have to drive through our state to get to WDW. If you do, you are really lost!!!

FWIW, I simply assumed that you were the passenger, not that you were being naughty.

But since you're in TN, their laws are important to know, and since July 2009, the law prohibits: "Using a hand held mobile telephone or a hand held personal digital assistant to transmit or read a written message while such vehicle is in motion."


Which means, DSLRuser, that creating the message while on the internet is just as illegal as actually sending a "text" message.

I agree. I'd be upset if the cop tried to turn my device into a cockroach as well.

And if the law says that they have a right to look at texts, then they DO have that right. Your claims notwithstanding.

I'm not versed in the laws in Georgia (which seem irrelevant anyway since the OP wasn't in that state), so I'm don't know that they have that right, but it may not be beyond the limit that they can go.

I was driving, how I got the message posted wasnt the issue. but if you feel its your business then I did have to get out and stretch my legs for a bit and get gas while I was waiting. I do text and drive though been doing it for 10 years now.

While you may have been doing it for 10 years, you now know it is illegal to do so in many states. So I'm sure you will do the right thing, and stop texting and driving. It is very dangerous. When you are driving your focus should be on the road, not on reading and sending messages. Such dangerous behavior on the roads is everyone else's business, as long as we are all sharing the roads with you.

Btw, one of the things I love about AAA is their triptiks. They will hi-light the construction zones for you, so that you can avoid them.
