Stealing a resale deal?

Sooo, I made a low offer on a contract from a very well known reseller..which I’ll let you guess. The seller countered with favorable terms so I accepted. Literally within 5 minutes, miraculously, the broker got a full price offer which the seller accepted. I can’t help but think that someone at the brokerage stepped in as the buyer on this deal. Of course I’m speculating, but the odds of that happening (and well after Eastern time zone hours) seems highly suspect. Of course I’m not overly affected, just seems unlikely. The counter was still a very good deal and appealing to any savvy DVC broker or buyer. Just wanted any insight or opinions anyone could offer. TIA

Side note, it was not a newly listed contract or even a decent value. I offered 40% less than list and seller counter at about 37% less than list..indicating an eager seller and not many offers I’m thinking. Just a bit more context

If the boot fits… yes I’d say you got ROFRed by the broker.

Was your offer the seller agreed to lower than the brokers "instant sale" price if they offered one? Just curious if the seller didn't realize the offer they agreed to with you was less then that and then the broker jumped in a scooped up the contract because they were shocked the seller accepted your low offer.

I suspect that happened to me on more than 1 occasion. Wont mention the reseller (wasnt the sponsor here), but I made a lower offer on a listing that was a month old. She told me the sellers would be willing to hear any offers. I made the offer the next morning, got the email that my offer was received. Took all day and then got a rejection email later in the evening that the seller accepted another offer and the listing removed... no counter, nothing..... HIGHLY suspect. This was for SSR and the offer was $80 just to get the conversation started.

yeah $80 for SSR depending on size of contracts and points available to use is higher that some " instant sales" prices taking into account all of the addition fees they put on the seller. So I would bet the agency stepped in as the buyer as soon as the seller accepted your offer.

I honestly don’t think it’s anything but another buyer. It has hapeoened to me when I was negotiating with a seller.

And at multiple brokers. If the contract had been sitting there, it doesn’t make sense to me why the broker would come in and take it all of a sudden.

If the seller was willing to accept a lower amount, then the broker could have done this at any time.

If you had only a verbal yes, then it’s not a contract.

Also, sometimes offere come in via email or chat and it is possible that is what happened during that short time.

I agree that it's probably another buyer. What probably happened is that they got another inquiry the same day and the broker told the other buyer that there is another offer on the table that hasn't yet been presented to the seller, or hasn't yet been accepted - which may have been true at the time of initial contact. If the other buyer really wanted it, they probably bid the asking price (assuming that part was true) and that offer probably came it at around the same time as yours.

I was on the other side of this once, except it was a listing less than 24 hours old and I thought it wouldn't last long. When I reached out I was told there was another offer came in that morning that hasn't yet been presented to the seller. They give me a 30 minute deadline to submit my best offer and said that the best offer will go to the seller then.

You have way more faith in brokers and salespeople than I do.

At least with DVC Resalemarket they told me there was a multiple offer situation and to present my "highest and best" by the end of the day.
This other broker, I dont trust as far as i can throw them... and I would throw a broker pretty far if I could... Right into a gator filled 7 Seas lagoon!

Sounds like the brokerage is shady. A deal is a deal and a verbal contract is actually enforceable.

Any person with morals would not be presenting new offers after you accepted, but unfortunately they care about $ more than they do their reputation.

Maybe because I have dealt with so many different ones and done a lot of being on both sides over the years. As a seller, I did indeed have something similar happen….an email that had a better offer that had come in earlier but just not yet read.

Got an offer and about 5 minutes later, got the email my contract was sold full price. Didn’t even have a chance to respond to the initial one.

And, before anyone asks, yes, had I accepted the first and found out a few minutes later there was a full price, I would have gone with the full price offer.

Not for timeshare sales…seller can change mind at any time if they have not yet signed. Plus it is why they allow multiple offers to be presented at once

I agree it could've been another buyer, but, I also think my offer was below the "instant buy" option, which I believe triggered the reaction. I find it a miraculous coincidence that a great deal was made to a contract that had been sitting awhile, and within seconds of making a great deal, a full price offer came in. Of course it could happen, but I think the probability is highly unlikely. Either way, it is what it is, and I will never use that broker again.

In that situation, it’s definitely not unique. There are plenty of brokers around who advise sellers that they can take time to consider multiple offers.

I realize some want to think the brokers are simply shady but honestly, as a seller, I welcomed the advice from all of them to get me the maximum I could for my contract in light of also wanting a quick sale.
