And wouldn't the company issued phones to McNally and Jastremski have been subject to review? And I believe they were? So would those phones be on the receiving end of TB's communication? If I remember correctly, TB was told his phone was not needed. It was further detailed he typically destroys his phones when being replaced.

I don't know, I still feel its bogus but at the same time, I just want it to end. They went to court, had it overturned then reinstated. Just be done with it now. Serve the stupid suspension and put it in the past.

Minority for sure. I live in the heart of Patriots Nation. Some of the diehards and yahoo's are all up in arms. I get it. I don't to see him suspended BUT if its gone through a court of law, appealed and overturned..... I honestly don't think he any direct dealings with this. I stated in the beginning that it was no secret he preferred the game balls on the softer side. He, like many of the other QB's have certain preferences and I'm sure those preferences make there way to the equipment handlers. Did TB directly tell them to inflate (or deflate) to a certain PSI? Doubtful. Did they know he liked them a certain way and if they weren't to his liking, they could possibly have issues down the road? Probably.

If this were just about TB, then he'd probably do it. But its not anymore. Its a fight between the NFLPA and NFL about this statement at the very end of yesterday's decision:

That points to a culture of cheating instead of a specific acts by Brady to cheat. Both are very troubling. And since Brady destroyed evidence I think it is fitting that he be punished specifically. I know the Patriot fans will argue until the cows come home that the balls weren't under inflated but I think this issue has already been decided. These recent rulings are not examining the cheating question as much as ruling whether the NFL can enforce its rules and issue punishment as it sees fit.

Agreed, but the evidence was pursued here vs only statements so far in the other cases. That might not be fair but everyone is playing the NFL's game and they are in charge of rules and punishment. I think that is the real issue here.

For those guys, there's not video evidence of a part-time equipment manager inappropriately taking the game balls into a locked room *after* the referees had inspected them. That same game-day-only part-time equipment manager previously referred to himself as *the deflator*, insinuated he has a scandalous story to tell ESPN, and received valuable memorabilia from Tom Brady.

The other guys have expressed their preferences, but they haven't admitted to going to the aforementioned lengths to get the balls the way they like them into a game.

Then they can ask the court's opinion on whether or not the CBA requires the same punishment for everyone who commits the same underlying infraction. I suspect anyone who has ever been a member of a union or worked for a large company already knows the answer.

At this point, Tom has to do whatever he NFLPA tells him. The NFLPA **has to appeal** to try to negate the broad powers of the commissioner that have been demonstrated during this process/precedent. This is no longer about the actions of McNally, et al, but about the CBA.

If you're asking what I would bet on, I was extremely surprised by the first Judge’s reversal of Goodell’s decision as arbitrator, so you never know.

Gosh, you'd think so but they do seem to focus on things they really shouldn't be involved in.

Personally, while I feel this was a complete farce and the punishment was ridiculous since there was never any evidence of any "crime", it just needs to stop. Let it go. Can we just move into the season clean? Please?!?!?

McNally also, in those text messages that became part of the undisputed record of fact in the case, insinuated he has a scandalous story to tell ESPN. Is that not evidence?

The only thing we can really dispute is how much TB knew about these actions, and why McNally took them. I’ll concede its possible that he did these without TB’s knowledge, but the Pats run a pretty tight ship. Is it really believable that a game-day only employee took it upon himself to tamper with the balls?

I’ll also concede that it possible that the balls were within the ‘Noble Gas Law’ expected ranges. That still doesn’t explain the trip to the bathroom with the balls. That alone, in a league championship game, gets to the integrity of the game no matter how good or bad a job McNally did of deflating the balls in the bathroom.
 
Well Tom is going to be out for four games. As he should had served this in 2015. Just IMHO!

It's over. TB12 announced on his facebook page he is not continuing his legal battle and will serve his suspension.
