Well it's been over a month and the other driver simply won't return his insurance company's calls. Since they can't get in touch with him, they won't pay the claim despite the fact that there were witnesses and the person that hit my wife's car told the principal.

For future reference, if you are ever in a car accident, simply ignore your car insurance phone calls and letters and you will be off the hook

it's very frustrating. I have no idea what to do now. I'll just have to be out $500

I was rearended a few years ago and the person that hit me took the full 2 weeks to respond. If they had not responded after the 2 weeks, my insurance company would have pursued them and taken them to court. I also had witnesses, plus I called the cops and got them charged with a ticket. There was just no way they could get out of it.

I can't believe your insurance company will let this drop.

You may be out $500 now, but your insurance company should get it back from their insurance company through subrogation.
 
I'm confused. Have you turned it into your insurance company yet? They should take care of everything for you and get your deductible back from the the other person's insurance company.
 
They do not totally get away with it.

Their insurance company will drop them especially if there is a police report documenting they were in a collision.

While that doesn't help you. They don't get to duck and cover and enjoy their insurance for much longer.

We have had noncompliant drivers before. And that is what we were r
Told.

On a different note...

I was hit by an uninsured hit and run. They never found him. But they found his vehicle and impounded it. No more ride for him.
 
I'm confused. Have you turned it into your insurance company yet? They should take care of everything for you and get your deductible back from the the other person's insurance company.

IME, an insurance company of an at fault driver refusing to speak will not pay. I assumed they would and I was wrong. But they wouldn't insure the guy any longer.
 
The fight is between your Insurance carrier and the other one, your insurer should be acting as your advocate. If the other person has insurance they are responsible, if not your own insurance's uninsured or under-insured driver coverage should take care of it... unless we are talking about a deductible.

What insurance company is this?

I was hit from behind. The police were called. I got the other driver's insurance information and called their company. They gave the other driver 24 hours to call in. They tried to contact him and told him to call. The next morning (not 24 hours) they took responsibility for my car. Gave me a rental car, delivered it to me and paid for my repairs. They took my testimony and the police report to prove that their driver was at fault.

They also told me they dropped him for not reporting an accident as was required by his insurance policy.

I also called my company and they stood behind me as being 100% innocent.



I can't believe they would allow this. What is your insurance company doing.


Mine would have paid less my deductible and then sued for all the money back. This would include my deductible. Thankfully I did not have to do this.

Auto Insurance Question. Wife's car was hit.

Background: My wife is a high school teacher. A student hit her parked car while she was inside the school. There were multiple witnesses to the incident and the student told the Principal. The principal paged my wife and got the insurance information from the student.

We filed a claim with our insurance company that evening. They at-fault party never called their insurance company. Since the student was at fault we are not going to take the money from our insurance company because we don't want to pay the $500 deductible so we are waiting for the money from the other insurance company. Our insurance company took over and contacted the other party's insurance company (Liberty Mutual).

Fast forward 1 month. The other party's insurance company has not been able to contact the student or the parents regarding this claim. They are sending a certified letter to the people today but I have a feeling that this is not going to work out in our favor.

What options do we have here. Anyone have any experience regarding this.

At our high schools, the kids who drive have to buy a special permit to be able to drive and park at the school. To get the permit, there is a form outling what their responcibilities are for getting to drive to school. One of those items is taking care of any accidents that may occur on the property.

Does the school your wife works at have a similar policy? If they do, has she gotten with the principal to let them know that the student that hit her has not yet addressed the issue. If any of our kids tried that, they would lose their driving permit. If they drove to school after having their permit taken away, the car would be towed and impounded. In order to get the car released, the kids have to have a letter from the school stating that the issues have been addressed. Which means mommy and daddy would have to go to the school, talk to the principal and you wife to settle that accident before the school would give Jr a letter releasing the car. And on top of that, they would then have to pay towing and impound fees on top of it.

I would see what pressure the school can put on the kid and the family, one way or another.

That's a different story totally. My insurance agent is apparently an idiot. She has been doing nothing regarding this claim. I've been doing all the leg work since she won't call or keep in touch with the other agent.

I will be switching insurance companies when this is over.

Not much. This is my first claim with them and as of now, they have not done much more than take my claim and contact the other insurance. I keep calling them and my agent is telling me to call the other insurance company

Mine would have paid less my deductible and then sued for all the money back. This would include my deductible. Thankfully I did not have to do this.

Since I haven't had much luck with my insurance company, i don't have much faith in them doing this.
 
This is what happened to me a few years ago. Guy changed lanes into me on the freeway and was apparently driving a borrowed car. They gave the driver a ticket,but in Texas (not sure how it works elsewhere) the car's owner is liable. The guy's insurance company supposedly tried getting in contact with him and he never returned the calls. I think it turned out that it was one of those dumb 30 day policies that people would use to get their car inspection and then avoid paying for insurance.

I ended up filing through my own insurance. I wound up paying the lower deductible for uninsured motorist coverage and getting reimbursed several months later. I swear, some of these little dinky insurance companies would much rather not get ahold of anyone.
 
I was broad-sided a while back and ran in to the same situation. The other driver would no return calls from his insurancr company. His insurance company kept calling me and asking me the same questions about the accident until I finally said "You have asked me these same questions a number of times. My answers will not change. Your insured drove through a red light and broad-sided me. The police reprort says it, the witness statement says it, your insured got a ticket. If your insured is not calling you back, then I think hat speaks to his awareness of his guilt". I then turned it over to my company to fix my car, which happened immediately. They then went after his copmpany to get all the money back including the deductible . About three weeks later, I got a check in the amount of the deductible to replace what I had initially paid out.

I LOVE, LOVE, LOVE Amica Insurance!!!!!!!!!!!!!!!!! They have insured me for 32 years.

Still confused. Have you actually FILED the claim with your insurance company yet?
 
It can be a slow process.

DH was hit by someone 3 months ago and the other driver was written up for being at fault. They decided to fight it though so our insurance company has already paid for the car repair and we had to pay the deductible. We got a letter a few weeks ago that said that our company was still wrangling with the other company and also trying to get our deductible payment back. Who knows when it'll be resolved...
 
Maybe try a different agent in the AAA office, since you are unhappy with the one you're talking to? Or call corporate to get them in on it.

I second this! I've had them for over a dozen years now. I've had two not at fault accidents, for one I was injured, and both times they were awesome. :goodvibes
