I am so angry and just have to vent. I bought an avon lipstick from a buyer on ebay and paid him 3 weeks ago. He never returned emails after the item wasn't received 2 weeks later. He FINALLY returned an email yesterday saying he was sorry, he traveled a lot and that's why he didn't reply sooner but he had lost the item. I was furious and left negative feedback for him stating that the item was lost and never received. He had the nerve to leave me negative feedback stating "HORRIBLE EBAYER, BEWARE DOESN'T PAY FOR ITEMS, STAY AWAY!" Can you believe that? What can I do? I emailed him telling him to remove it or I will report him to ebay and wrote a response to his feedback, but I don't deserve to have his nasty comments in my feedback for HIS error. I am furious, I've never had someone do this to me. I still have his email stating he lost the item, can this be sent to ebay?

When he advised you that the item was lost, did he refund your money?

If so, IMHO I believe leaving negative feedback might have been harsh, instead Neutral feedback might have been better. His leaving you negative was a revenge type of thing because of the negative you left for him. You could see about mutually agreeing to remove each others negative feedback? Otherwise you would have to file a complaint with Ebay and send all of that information.

I typically only leave negative feedback for those that take the money, don't send the item, don't refund, and don't respond. If they do make an effort to resolve the issue, I will leave neutral.

BTW, I totally HATE when people put up auctions knowing they will be out-of-town when the auction ends!!!! When it ends, I assume I will hear from the person in a day or two, not a week or so later when they return from vacation. Why not just wait until you get back to sell the stuff?!

I would report him to ebay. Send prrof to ebay to prove that you paid and a copy of his e-mail saying that it was lost. he can't get away with lying in his feedback can he? he said you didn't pay but you did. I think that's just wrong!
 
If he advised you that he lost the item AND he refunded your money, I probably either would have not given him feedback or left a neutral since he did give back the money. I only don't leave feedback if the transaction didn't work out but everything put "put back in its place"...but that's only happened once to me. However, if he *didn't* refund the money, the negative was justified. But always be cautious when giving a negative, because more often than not, they will "return the favor." Nowadays, when I've won an auction, I do not leave feedback until the seller leaves it for me first. I do it first if I'm the seller. If he has not refunded your money, definitely file a report with ebay and let them know the transaction history.

It does not appear that these would be relavent in your circumstances though. If you are so inclined, you could attempt to contact the seller to see if they would be willing to mutually withdraw the feedback (you'd both have to agree to this) and you can read about that here:

I wish you luck and just want to offer a word of advice. Cool off before leaving any neutral/negative feedback. I know how tempting it is to type off a comment in the heat of the moment and then realize later how damaging it could be to both parties involved. I always wait at least a couple of days after a bad transaction to cool off and calmly leave appropriate feedback. Not pointing my finger at you, OP, just stating what has worked for me in the past.

Also, unless things have changed, you should be able to reply to any feedback left for you. So you can reply to his negative feedback with a response. Then when people look at your feedback & see his negative, they'll see your response right under it.
 
I find the feedback system a problem with e-bay. I now never leave negative feedback first, because you can guarantee that they will then leave negative for you. It's unfair when you've done nothing wrong.
My cousin has been very unlucky and left negative for genuine reasons on a few occassions (for non-payment etc) and each time has had negative feedback left for her.
BE WARNED!!!

Thanks for all of the responses I will do some research. To clear things up, yes he said he would refund the money but didn't, so I thought that warranted negative feedback. It angers me so much that he just outright lied calling me a horrible ebayer and a non-payer which I am not. I hope ebay will resolve this.

I've had two bad experiences with e-bay and I did not leave negative feedback for either seller. One I recovered the money through PayPal. The other I paid by check ($120!) and had to just take my lumps. I knew I was taking my chances paying by check so have no one to blame but myself. In both cases, I did not leave negative feedback because I knew the sellers were unscrupulous enough that they would leave negative feedback for me in retaliation.

Needless to say, the fact that people fear leaving negative feedback when it is truly warranted means that the e-bay feedback system is unreliable at best and completely useless at worst.
 
Did you give him enough time to actually refund? I think I would have waited a little longer before jumping in with a negative. The only thing you can do now is ask him for the refund and then if you can both mutually remove the feedbacks.
 
I always pay for auctions by credit card, that way if something goes wrong, I can always call the credit card company have issue a chargeback. I've had to do that once because paypal wouldn't credit my account when the seller took the money and ran.
 
I think this is a problem with the feedback system... E bay won't do anything for you- they can't keep track of the really big" con artists" in there- But I have left some neg. feedback, very carefully and after much thought, b/c I know it will result in a retaliation. But what happens when we don't let others know that the person is unscrupulous? Then they still have flawless feedback, and continue to cheat others! I have taken a hit or two on feedback, and had a couple of lies told, :sad2: but I have overwhelmingly good feedback, so I figure that's enough for folks to figure out if I'm trustworthy or not, though I know- those mean spirited lies do sting!
 
Unfortunately the flawed feedback system is one of the reason that many poeple use 2 ebay IDs-one for selling and one for buying. That way if they buy something and the transaction really does not live up to what they promised, then appropriate FB can be left without fear of the retaliation affecting sales. I don't do it but many people do.
 
welovedisney, that is an interesting idea. I never thought of it actually. We do have two id's but that is because I was planning to build up my feedback thru buying and then start selling with my own ID. Maybe I will just stick with this current system.
 
DId you pay with paypal? You need to file a claim immediately. They will immediatley take money from him andf investigate. DO it ASAP as you have only so many days to file a claim.

I did file the claim today since he hasn't refunded the money, I paid 3 weeks ago. It's not much, it's just the principle. Does anyone know what the process/investiation that paypal does is like? How long does it take?
I like the idea of having 2 ebay accounts, I may need to do that.

i had a problem 1 time the guy said the item was new well it came with no serial number on it. so i contacted him for 3 days i got nothing so i got ahold of fraud protection and paypal and ebay along with a goverment agancie well in 2 hours he got ahold of me and 10 minutes latter i had the money back in my account all of it including shipping to send it back to him. then on ebay you have up to 3 months to leave feed back i waited ontil the 89 day at midnite and posted so he could not post back on my account. just a little something to keep in mind.

You should get an email from Ebay pretty soon regarding the claim and the process. Typically what will happen is they will review your claim to determine if a refund is due (which it is in your case). They will then contact the seller and give him a certain amount of time to respond to the claim. The seller can agree with the claim and refund the money or if he doesn't respond, they will deduct the amount from his account (if he has any money in his paypal account). If he doesn't have any money in there, they will let you know that they have determined that you are due a refund but he has no funds in his paypal account to cover it. I think then if any money is posted to that account it would be taken. (this part could have changed since I went thru it a couple of years ago) You should read the email they send regarding the claim.

It used to be 90 days but you can leave it much later than that if you have the item number, at least it has happened to me that a buyer left positive feedback more than 5 months after the transaction. Here is eBay's info on this:
"If you need to leave feedback for a transaction that is more than 90 days old, you may do so using the "single transaction form" link located on the Leave Feedback page. Remember, eBay only commits to items being available for 90 days, so if it is greater than 90 days you may not be able to leave feedback."

It says you may not be able to leave it but it definitely is no longer a strict 90 days for those who think the other person can't respond to your FB left on the 89th day.

GL to the OP. You should get a response shortly, especially since the item was never shipped, he would have to show them delivery confirmation or some other proof positive that you received the item (at least I am fairly certain that is the proof needed--if anyone else knows more please jump in), so it should be pretty straightforward. Just check your paypal page and click on the "resolution center" button (or something like that) it will give you the status of the dispute.
