Short child molester gets probation

This may be the single most idiotic ruling by a judge I have ever heard. This just infuriates me. Not only that, but it is pure stupidity to alleviate punishment due to one's height. I guess the judge did not wish to take the height of the 12yo victim into account. You can read about it here.

Most outrageous is what the judge said:

She told Richard W. Thompson that his crimes deserved a long prison sentence but that he was too small to survive in a state prison.

Ok, how on earth did she come to the conclusion that he was too small 'to survive' in a state prison? Is there some sort of evidence to suggest that short men are not surviving prison?

But Joe Mangano, secretary of the National Organization of Short Statured Adults, agreed with the judge's assessment that Thompson would face dangers while in prison because of his height.

"I'm assuming a short inmate would have a much more difficult time than a large inmate," said Mangano, who is 5 feet 4 inches tall. "It's good to see somebody looking out for someone who is a short person."



I think in this instance the Judge should be ordered to do the perverts time!!!

U.S. prosecutors to appeal probation granted to short man convicted of child sex abuse

This state's attorney general says he will appeal a judge's decision to put a convicted child molester on probation rather than send him to prison because his short stature would make him a target for other inmates.

"This sentence is far too lenient," Attorney General Jon Bruning said Thursday. "Anyone who sexually assaults a child deserves to live their life behind bars for awhile."

Bruning said Thursday that his office will file the appeal within the next two weeks.

What am I missing here? How is he unfit for incarceration because he is short Is it because he comes to an inappropriate level to the other taller convicts? Is there a fear of him being squashed during a prison riot? Will one of the other inmates set a drink on his head during rec time? Does his shortness predetermine the inevidability of him becoming someone's beeatch? How is this a defense? The man MOLESTED a CHILD...he has no right to entertain any real or perceived notions of discomfort in my book Tie him naked and covered in syrup to an anthill.....sorry, that is my answer for all of those who offend me

So whats the cut off to actually be sent to jail? Im 5'2"....can I commit a crime since Im short and wont be sent to jail? Absurd!
