We unfortunately have to let go of our DVC contract.

We were planning on going through the TSS based on all the great reviews here. However a friend of ours may be interested in buying it.

Can this be done? Does Disney still have ROFR? Can we change the name on the deed or something to our friend?

Anyone know any way to do this on our own? My husband works at a large lawfirm so does have legal advice at the ready but i know DVC is not like any other time share.

Thanks for any advice!!

you can do it on your own but you still have to submit it to disney for ROFR.

Guess we should just tell our friend to buy from TSS :goodvibes. I have no idea how to submit to Disney for ROFR etc and all the paperwork.

Sounds too complicated to me....unless someone can explain otherwise :confused3

you could probably use the closing service that TTS uses even without TTS selling it. If they sell it there would be a sales commission. If they don't sell it, you could just use the closing service. Sales commission fees and closing fees are separate in the fee breakdown, all are negotiable. In my purchases, the seller has paid commission and I have paid closing as the buyer, but all my checks have been made out to magic vacation title, which handles escrow, papers and such.
Might be worth an inquiry to TTS.

May be worth checking around with some of the "big 3" resalers and see if any will cut you a deal based on you not really needing any "sales" help but just need them to process the deal on your behalf.

Personally I don't know all that's involved, but before just giving up the standard 10% I'd at least try to see what they can offer you. Not sure if any of them would do that but it's definitely worth a phone call or 3.

Willing to bet that some others here can provide a bit more on the details of the process.

I would contact Disney. I have read that they will send you the paperwork for ROFR (not absolutely positive on this) and then once it goes through that, maybe someone at your DH's law firm can help with how to get a new deed filed.

Good luck!

Thanks for the advice on contacting TTS. They did state if we bring our own buyer then we just pay a $500 commission rather than the 10%.

We are possibly buying my sister's contract. I spoke with our guide today about adding on at BLT and mentioned purchasing points from my sister. The guide told me to call Member Services and they would sent out a packet with the info on ROFR. We would just handle it between ourselves and then have a title company file the papers for approximately $350.

If you want to sell, they want to buy and you can agree on a price, it's perfect for both of you. You'll save the 10% commission and can give your friend a slightly better price, win-win in my book. ROFR is easy, all you need is a contract spelling out the specifics and send it to member admin. They'll either buy it or give you a waiver. Once you get the ROFR, you can decide whether to use a closing service or do it yourselves. IMO, this is the perfect situation to do it yourselves but you should be able to get it done by someone else for around $250-300. Some of those will also do ROFR but usually charge an extra fee. One thing to note is my understanding is that it is illegal in FL to put one price and charge another. You can't secretly agree to a lower price or rebate than what you put on the papers just to get past ROFR, at least legally. I know it has been done but at least you know the info. Contact DVC member admin and they will send you info. If you send an email to MS, they will forward to member admin who will send you an email back with the info as attachments. IF you email me directly, I can also so you some info from last year when we changed the names on deeds but I'd still check with MS as things could change over that period of time.
