Selling back to Disney

We are thinking about selling our points. After doing some homework, we have basicly found out that the price we would be asking would be low enough that chances are good that Disney would exercise its ROFR.

Rather than go thru the time, effort and expense of using a broker only to have Disney use its ROFR in the end; does anyone know of a way to skip the middleman and offer it to Disney directly?
 
I don't know.

It sure would be nice if there was a way to do this.

Do you still pay the commission if you use broker and Disney buys the contract?
 
I actually never asked if a commission still applies. I don't know. Any sellers out there who had Disney use ROFR answer that?
 
When DVC exercises ROFR they get the same deal as your buyer. The commission is between you and the real estate agent, it has nothing to do with your buyer, so it's not part of the deal DVC gets. If DVC had to pay the commission, it wouldn't be a good deal for them anymore.
 

I don't know if Disney buys back direct. You can always ask. If that does not work, you could try e-Bay or the TUG. I believe you can list to sell on either of those. But then you have to get a closing company to do the transfer.
 
My guide told me DVC doesn't buy points directly from members, you need to go through the ROFR process with an offer from a third party.

We just had our resale pass ROFR. We found the listing on the T.U.G. website and sent an email to the sellers expressing our interest. The seller accepted our offer and sent us a buyer/seller agreement via email that we signed and mailed back to seller. She sent that along with a cover letter to DVC stating her intentions to sell. She had also contacted a title office in Orlando to have them finish the transaction.

In our case, DVC was going to exercise ROFR on the first offer but we still had some room to negotiate and immediately notified the seller that we wanted to counter offer. DVC was not happy with that development but allowed us to proceed. Our second offer passed ROFR and padded the sellers wallet a bit more.

So, it can be done without a broker involved. It really just depends on how fast you need the money. Our transaction took about 10 weeks from start to finish. I'm not sure how long the ad had been posted before we contacted the seller. Another factor will be how many points you are looking to sell and at which resort.

I think that you would find that selling direct, not through a broker, would be more time consuming and more of a hassle.

Contact a broker, you will find several recommendations on here, they will explain the process and essentially they will do all the work. You seem interested in a fast sale and will price accordingly. The broker can give you pricing advice based on their experience.

Since you have already indicated that you are not looking to get a high price per point, you should be able to take the price that you want and increase it enough to cover the broker fees so in the end it would be no effective cost to you.

Based on what I have read, selling through a good broker is a pretty painless process.
 
DVC will not agree to buy back directly. You must have a valid contract FIRST.

Our situation was interesting as our first offer was $68/pt. but the sellers were paying the closing costs and giving us a credit of $10/pt. for the '04 points that had already been used. When we heard DVC was exercising ROFR, we counter-offered @ $65/pt., which was lower than the first offer, but we agreed to pay the closing costs and there would be no credit for used points.

It almost seems as though the seller paying closing costs is more of a red flag than the price per point.
 
If you know your price is low enough that Disney will exercise its ROFR, then why don't you arrange for a "friendly" buyer to sign an agreement with you and then submit the paperwork to Disney. Then you won't have to pay the commission to a broker.
 
I used DVC by Resale yesterday to sell my Vero Beach holdings and within 2 hours, I had sold my 100 points at Vero Beach for $64/point. Whether Disney will go after that or not, who knows? But at least it will be a done deal soon enough!

I like working with Maggie and Shontelle at DVC by Resale and recommend them highly.
