ROFR Thread April to June 2025 *PLEASE SEE FIRST POST FOR INSTRUCTIONS & FORMATTING TOOL*

There are primarily two main FIRPTA agents most Brokers are recommending. None of them are based out of Canada. I'd highly recommend you retain one based in the USA.

To clarify, in order to apply for and receive an ITIN you are required to provide the FIRPTA agent with a certified true copy of your passport. You can obtain this through Service Canada. Going to a US Embassy is not necessary.

Unfortunately, applying for an ITIN is required if you wish to sell. No title company is going to close on the sale without you having one. There is too much risk to the buyer because once title transfers to them, the owner of the real estate is liable for any outstanding taxes on that real estate. With no ITIN, there is no way withhold your 15% FIRPTA.

Once you've provided the FIRPTA agent with your certified true copy of the passport, they can issue the required paperwork for you to close knowing the ITIN will be processed. The title company will hold back the 15% FIRPTA and the FIRPTA agent will finalize the paperwork with the IRS afterwards.

Right now, it is taking the IRS about 20 to 24 months to process the refunds for those who paid the 15% and applied to have it reimbursed.

For clarity, I was the buyer, not the seller. Hence my displeasure getting sucked into an arduous process. But I’ve signed off on cancelling the contract smoothly now!

Even Service Canada is a pain I don’t have time for.

I now know I’m holding what I own until expiry unless I have more consistent time on my hands. 😂

Just enough to make it so I can book PV and not worry about the SV game. I am going to go all RIV soon and selling my Poly, so having extra points at BW is kinda useless to me. If not for that I would have just bought 25 resale for much less per point. I figure I will make it up in not paying MF on 10 points that get pushed year to year.

I’m so sorry you had to let it go seems like it was for the best though.

We've sent pigeons, emails, even a DVC tote bag filled with snacks as an offering. Still, silence. Jenkins swears he heard a faint "declined" whisper in the wind yesterday, but it was just the Saratoga Springs brochure rustling. We’ve taken to carving “USE YEAR” into the ship’s mast to pass the time. If this drags on much longer, we may have to eat the seller. Or worse—buy direct.

For what's it's worth I received this from my agent 2 days ago (June 30th)...... "Disney reviews for ROFR normally takes 30 days but they are behind and are currently taking up to 50 days." I believe my contract was sent this week so I'm just going to assume 50 days and hope for the best 🤞

Probably due to recent holiday and with a holiday this week, they will likely get backed up even more.

I am on day 27 as well. 🤞 the response from Disney comes soon for all of us. :-)

On a related note, a few nights ago I was curious about all the data and how many days on average it has been taking (based on the data posted here). It looks like for the past three months, it has taken an average of 23.9 days for folks to get a response from Disney on ROFR.
 
Probably due to recent holiday and with a holiday this week, they will likely get backed up even more.

Ugh. My contract was sent June 5th. It’s a February UY so I need to bank points by September 30th.

I am on day 27 as well. 🤞 the response from Disney comes soon for all of us. :-)

On a related note, a few nights ago I was curious about all the data and how many days on average it has been taking (based on the data posted here). It looks like for the past three months, it has taken an average of 23.9 days for folks to get a response from Disney on ROFR.

We're all on the same boat! I had seen the same data 23/24 days and even some contracts in the ROFR clearing that were sent June 2nd (last Friday clearance) so I was hoping + 3 days for our June 5th contracts. Gotta be soon! Keep the faith!
 
If you decide to buy resale again its always a good idea to ask points be banked before going to contract if your goal is to bank the points once you get them

Ahhhh got it. Yes, if you are the buyer you don't need an ITIN unless you are buying from another international seller. Then you do need an ITIN.

Glad you cancelled. On to the next deal!

Ours is a Dec UY and I was super worried about not hitting the banking deadline of end of July. I asked that they put the 2024 points into 2025 for ASAP and got the broker to send me a screenshot. Made me feel a lot better. Now to just keep swimming on day 19 of my ROFR wait.

You think Disney would rubber stamp the resorts they don’t want to buy back quickly to catch themselves up. Like only looking at Poly and GCV and AKV or something.
