Renting points- contract question

Hi, I'm sorry if this isn't the right place to post this... I'm really new at this.

I'm renting points for the first time. I found my renter on ***********. They seem very reliable, and they had people send me emails as references.

I got my contract today- my trip is booked, and I need to sign and mail back the contract as well as half the agreed price as a deposit. As the contract was emailed to me- it is not signed by the DVC member who is renting to me.

Is it safe to sign and mail the contract and the deposit even though it is not yet signed by the DVC member? Like I said, these people do seem trustworthy. It even says all of their contact info on the contract- including address.

I just need some reassurance.

Sounds like a legal question that none of us can answer.

In business (not real estate), I always send contracts unsigned. When I receive the contract returned, I sign and give an executed copy to the other party. I do this to ensure the other party doesn't modify the contract with my signature already on it, and then have an executed contract with their modifications.

Sound like the same thing, but you're on the receiving end of the contract and not the originator.

If you trust the person enough to send money and your trip is already booked, I would worry about signing the contract with the other countersignature first.

In all reality, if something happens are you really going to go sue the person? I'm guessing they don't live close to you. If you are at this point of comfortableness with the transaction, that is a minor detail.

ps - contracts get executed in parts all the time.

Personally, I think these contracts are useless because they are pretty unenforceable. You have 2 private parties, strangers to each other, signing paper remotely without any in-person knowledge or id check.

I can try to rent as "Mickey Mouse" and sign my name as such... would that offer the other end any protection? They don't even check your ID when renting out their points anyway.

I know it is certainly not fool proof and anyone could easily send something fake, I usually request a copy of drivers license.
