ideally, yes. but an inexperienced owner might not know to tell MS to use the 08 pts first...and an inexperienced MS cast member might not switch pts around to use the 08 pts first.
it can happen. the owner is responsible to pay attention...

A guide is just a salesperson so unless you are planning to add on it doesn't really make much difference if you have one or not. You will be assigned one, who may or may not contact you at some point. People who buy direct have had some luck getting a guide to make a hard to get reservation for them to close the deal but normally unless you are looking to add on you don't need to contact your guide. Member services is the important group of people who answer questions, make reservations, do accounting etc. If the 08 points were banked into the 09 use year then they may be good until the end of the month before the use year starts. If is is a Dec UY then the points would be good from Dec 1 2009 until the last day of Nov 2010.
One way to have 08 points and 09 points would be that the owner simply thought that they would take anothe trip during their 08 use year, so did not bank the points early. Went ahead an made reseravaton during their 09 use year, using 09 points, then decided not to travel any more in 08, then banked those 08 points...so some 09 points would have been allocated for a trip before the 08 points were banked.
After the points were banked, the owner needs to call member services and ask them to reallocate the points for the vacation using the banked points and releasing the 09 points.
Many owners don't seem to fully understand their DVC ownership, and I suspect many points simply expire every year because of that.

A guide will be assigned to you after you close when you purchase via resale.

If you make an offer on a contract that has points you will be unable to use prior to their expiration date, do not assign them any value.
For example, if the contract has a December use year and banked points from 2008, those 2008 points will expire on 11/30/2010. If you can't use them before 11/30/2010, they will expire. So those banked points have no value to you.
