Question regarding Unemployment Benefits...any experts?

MY husband worked for a large manufacturer for 17 years. The plant closed last year due to slowing sales and two new plants going to China. Once he started getting unemployment last year (October and part of November) he found a job as a manager at a fast food place. Good money but he was working under horrible working conditions...he lost over 50 pounds because of the stress ...a long story...bad boss.. Anyway...He recently quit that job (end of June).
I though I had read on here that he could re-file for the unemployment benefits from the plant that closed. Is this possible? He worked for the fast food place from mid November until end of June. Even though he quit...could he get benefits from the fast food place even though he quit (hostile work environment)???
He IS looking for work and has had an interview but will not know anything for a few weeks.

Does anyone know if he can re-file from the closed plant or even the fast food place??
 
I'm not an expert, I'm an HR Manager who has seen alot of unemployment claims come across her desk over the years. Each state has slightly different laws so you'll have to verify the policies in your location. Generally when you quit a job you are not eligible for unemployment benefits. There are some exceptions (sexual harrassment, being forced to do something illegal, etc.). The unemployment commission will thoroughly investigate those claims. Unfortunately your husband probably won't be able to refile from the plant closing, he's had another job since then. The restaurant is the job that the determination would be made on. There is sometimes confusion about that because of the way the bureau charges the benefits to the employers. While a previous employer may be charged with some percentage of the benefits payout, your eligibility is determined based on your most recent employment. If you feel strongly about the reasons he resigned from the restaurant, he can try to file and see what happens. The unemployment bureau can deny the claim outright or send it through. The employer may dispute it, but then again they may not put forth the effort.
 
I quit a job many years ago, hostile environment, state was Michigan. If you quit, there was a 13 week penalty, after that you could receive unemployment. Again, I'm sure rules vary by state.
