Preschooler carseat on Airplane question?

my 4 yr old is MILES from the 40 lb mark. Heck, my 9 (almost 10) yr old is just about hitting the 50 lb. My DH wouldn't fly w/o our kids in car seats anyhow so it doesn't matter for me. My little guys seat will be going on the plane with us

I would find it odd that their policy would prohibit you from allowing your 4yr old child to fly without a carseat when you can have an infant ride on your lap unrestrained.
