Possession of Marijuana

I just found out an old friend (we haven't talked in a year, but we were very close) was just arrested for possession of marijuana, here in Kentucky. I looked up the penalty and it said up to one year of jail and $500 fine. This is, I believe, her first offense (though years and years ago she was arrested for public intoxication). I'm wondering if anyone here knows if they usually get probation for first offense or maximum penalty.

Also, she works as an educator who works in different schools here in the county (I'd rather not say more or give details) and I'm wondering - do you think she could lose her job?

And for those who are wondering, I do not partake. :smokin:
 
A lot would depend on the quantity. There is a big difference between simple posession (usually just a misdemeanor) or possession with intent to distribute (which is a felony).

Knowing her it was probably a small amount, however she was in another town and I suppose it's possible she went there to purchase a larger amount to keep at home.

She wasn't charged with anything else, which I think is kind of strange. I guess she either wasn't arrested in a car, or she wasn't driving. I found out about it through the newspaper.

Is it common for the judge to order subsequent drug testing? I hope so, for her sake.
 
Anyone else know someone who's been charged and sentenced for this?
 

My hunch (and that's all it is) would be she'll get a fine, maybe some probabtion or some counseling. Doesn't sound like she has much of a criminal history. The keeping her job issue will be much tougher. Hope it all works out.:)
 
She may be able to get it filed and agree to treatment. If it gets filed, it will not show as an arrest unless she gets arrested again in a year.

then both arrests will take effect.

Do you know if they notify employers. Like I said, she was arrested in another town, so likely no one she works with will see the paper.

We went to Venice Beach recently. It made perfect sense to me that we saw a medical marijuana facility right there on the Boardwalk. It was odd, but at the same time, it just seemed right to have one there. I was surprised to find out we could just walk in, get an Rx there on the spot, and leave with the medicine, if we so desired.

Wow. Yeah, it's very different here.

It wasn't in the paper as a story with a headline, but they list all arrests once a week. It's a small town where she was arrested.
 
She needs to check with her lawyer. She can ask for pre-trial deversion and counseling (if available)

As to her work being notified. I would check the state laws. Some states have a law that if you are employed in certain jobs, your employer must be notified about certain arrests.

I feel any prosecution of marijuana charges is a huge waste of tax payer dollars. JMHO, of course.


I think as a PP mentioned, it would depend on the amount. And hopefully, with it being a first offense, she'd be okay. :hug:

We spend too much time and money going after pot. It is time to legalize.
 
They just arrested the Dunkin Donuts guy in a town near me. He was making a "Sunday Special" muffin. Pot Muffins! He sold them right out of the dunkin donuts!! He was baking them there!

No wonder the 'time to make the donuts' guy was so groggy - yet dedicated. ;)
 
DH says they should regulate and price control pot, cocaine and a few other drugs and sell it over the counter at the pharmacy.

He said once they're selling it at Target and Walmart it will drive all the criminals out of business.
 
Okay, Ky. criminal defense attorney here.... In most counties she should only receive a 30 - 60 day sentence probated for 24 months and pay court costs. They might make drug testing or counseling a condition of her probation. In some smaller counties they do require jail time, crazy as that sounds. If I was her, I would hire an attorney to take care of it. She is more likely not to get jail time if she happens to be in one of those crazy counties if she has a local attorney. Key word...Local!

My guess is she is going to be in big trouble with her job if she is in the education field. Good luck to your friend.

Could be, but it is still currently illegal.

And after the move by mexico, it is only going to help prove the points aginst legalizing marijuana, or any other substance.

why you ask? because its probably only going to be a few months until stories of overdoses, or vehicle accidents start taking the news by storm, because with the de-criminalization of ALL forms of use, there is noting to stop people from smoking, inhaling, or shooting up their choice of poison 24/7, no matter what they are doing.

I bet the death toll goes way up in the next six months to a year.

Some people crying about Michael jackson? heck, just wait till the "spring break" crowds hit mexico.

and all the while, the public attitude will change.

It is illegal. My guess is, as a teacher, she will lose her job and possibly her career.

She is going to have some problems on the school front. When working with kids there are criminal history checks and disclosures.

She will if your area has a ARD acellerated rehabilitation Disposition....for first time offeneses that no injured party. But, the larger penatly is going to be the facing the music of the school system. If you read it in the paper, they did too. She has to disclose it, they will find out and it will be worse.

I don't understand when people are in the just say no, mentoring and position of influence on the kids, why they make poor decisions.
I also know that the courts are over filled with criminal and cival cases.
there has to be more than a possesion. Either there is suspected distribution, large quantites being purchases and possesed, or found in relation to another crime.

Just to stop someone and charge with small possesion is unheard of. That has to be a lowered charge, because of sympathy that she would lose teaching certification, or she gave names....
