Phone/mail fraud?

I'm just wondering if I can take action for something like this or not.

Long story short, my ex paid a friend of his to call my husband at work on Friday and identify herself as someone working for a medical company in Florida and she had received some of our mail (which, oddly enough, we have been missing). My husband honestly did not think much about it, gave her our info, then after hanging up realized what he may have done. :headache: He star 69'd it and gave me her number to call (number was in my ex's city).

I called and she reverified that she worked for this medical company and had received our mail, and just wanted to get it back to us. I asked how she knew what my husband's phone number was. She responded with that one of the pieces of mail had his company name on it, but apparently her husband was a customer of that company as well and knew him through that. I told her that I personally felt uneasy about it, because I have a lot of problems with my ex and didn't need him getting my information. "Oh, no ma'am. I would NEVER do that." was her answer.

Of course, I get out of work a little while later, and my ex's new wife left a message wanting to verify if she had our correct address. ANGRY is an understatement. I tried to contact the woman back for several hours, but due to the storms in our area on Friday, the lines were down. When I did get through, they were closed...but I discovered she had left her cell phone number on her voicemail. I called a few times and finally left a message stating that she at least owed me the courtesy of calling me back and telling me why she lied to not only my husband, but myself.

She called back Saturday morning at 12:45 saying that she was paid to get our information and if I didn't want her to call the cops for harassing her, leave her alone.

I actually called her business today and spoke with the office manager and complained for a good 20 minutes about how angry I was that this woman would misrepresent herself as working for this company to get our personal information. The manager was pretty upset as well. He didn't take it very lightly that she was posing as one of his workers in lieu of money. I wish she would get fired for this, but I know that she won't....I just wonder, is there anything that I can do as far as mail or phone fraud against this woman?

My husband feels so awful for falling for this little game, but I'm not 100% blaming him. We are honestly missing mail, and a lot of it. I'm not sure why. The post office doesn't think it's their fault, and we live where our mail is under lock and key.

Sorry for the long post, just very angry that someone would stoop this low.:mad:
 
Tell your attorney all of this and get his/her advice on the matter as well...

I'm going to have to get another attorney since I dropped my last one. Paying out the nose for his services wasn't the best idea ;)
 
You can call the police department, or your city's Law Director. They can tell you if you can press charges or not. They won't charge you for their time.
 

Depending on the info he accidently gave her, try and protect yourself as much as possible. Call either the police or the State's Attorney fraud division and explain the stiuation. Contact all three credit reporting agencies and place an alert on your name, DH's name and even DD's name. Find a new attorney and retain him/her and explain situation.

You want to make sure you are covered for as much mischief as you can manage and only speaking to the attorney will actually cost you any money.
