We are a military family and our home of record is Oregon. I don't work so have no income to file. We have been stationed outside OR since going active duty (prior national guard) I am just learning that OR doesn't withhold state income tax for those stationed outside of Oregon. However, not knowing this we haven't had the correct W4 form filled out and didn't know about this other form to include in our filing so his state taxes held would be refunded. Does this then mean I could file and amendment with the form 40 and be refunded those withheld taxes?:confused3

Hope I didn't just talk in circles I'm still confused on it so it's hard verbalize my question. :rotfl:

Thanks for any help anyone can give! :worship:

above is a link to the rules. I am assuming from your post that the tax that was withheld was actually paid to Oregon. If yes, it sounds like this applies. If another state took the taxes out, you would have to file in that state to see if you get a refund.

THANK YOU! I think I'll print that off with our taxes and see what the tax office can do for me.
