Opps, Rofr Got Me

We don't rent ours as a business but when we do occasionally rent them we rent them at 12 dollars a point.
 
OK, so let's get back to something near and dear to me right now...ROFR....
I was also told that no one takes the counter offer as the seller gets the money from Disney immediately.....but since I and a few others HAVE been caught right in the middle of the price increase, I think it is something to pusue...
My question is....the resale agent is working for the seller, and if you call the agent and say you would like to counteroffer, how do you really know if the contract was REALLY ROFR'd or just told to you to get you to raise your price???
Also, I thought about contacting the seller directly sice I have their name, and asking that they let us counter, but then they might decide to just shop the contract again if it is ROFR'd...so, bottom line, I want to counter and will make it a good offer in light of the price increase, but I want to be sure that 1. the counteroffer is presented to the seller 2. the seller doesn't pull the contract and try to sell it again....
Any suggestions would be helpful....gosh, I don't know HOW I'm going to get through the next few weeks waiting on this!
Also, who has been successful in counter offering and how much did you increase your offer???
I spoke with my guide late yesterday and he tells me there have not been any BCV inventory points in months.....not a good thing for me...

belle3, while a "counter offer" doesn't seem to happen that often, I doubt it's an issue of the seller going after the quick bucks very often. I don't know a lot of people that would turn down an extra $500 free for another 30 days or so. Although I'm sure there would be exceptions. Personally, I'd contact the seller directly for two reasons. As noted, the broker has a certain amount of conflict of interest plus if the seller is not aware, it's likely hte process will move slow enough that by the time you get a counter offer going, it's too late.
 

I would contact the seller as well. This is a unique situation. For you, the "rules" did kind of change mid-stream. And yes...the agent DOES work for the seller, and they get paid whether DVC gets the contract, or you do. The agent is DEFINITELY the one who gains the least if your counter is accepted (10% of $500 isn't much, and they have to re-write, and re-submit the contract). The seller is probably unaware of DVC's new "pricing policy", and would love to take more money if that becomes an option.

There's not much detail there, except that there was no "broker" or agent involved. I remember that I was new to DVC at the time, and he and I had some talks about this...I was repeating what my agent had told me about how sellers didn't want to wait 30 days, and he/she kept saying that theirs was THRILLED to wait. That made me think...maybe it really IS the agents who do not want to wait...maybe they never DO present the counter to the sellers. I hate to think that. I used TTS and they were SOO nice...but, they were NOT working for me!!

All I can say is this...if it were MY contract...I would do everything I could to keep it!! The worse thing the owners can say is "no"...and, then you are NO worse off than you were before. But, if you don't try...you will ALWAYS wonder "what if".

On a good note...someone just passed BCV @ $72 per point. Maybe DVC is not being as "aggressive" as feared...maybe they just want to "buy low and sell high" to increase their profits!!!

Thanks, Beca, I just read a 72.00/point at BCV stripped until Oct 2005 that was ROFR......EEK....looks like I am walking a FINE line on this one!!!
I agree 100% that the brokers only get 10%, so it is possible that they never even present the counter offer as it is not worth their time and they do have the money already "in pocket"a lot quicker.....
I have to go out of town his week, but I will call them when I get back and hope they are interested in what I have to present!!!

Belle3, I messed up when I posted this originally! I just looked at the e-mail from Jaki and the ROFR'd contract was for BWV, not BCV -- but still!!! Sorry for posting incorrectly!

My guide called to let me know that DVC had raised the price on resales, so the ROFR prices have gone up.

He also told me DVC "might" be getiing into resales soon. Hence their exercising of ROFR??

Just thought this was interesting.
