Hmmm... you're confused? Okay let me try to clarify: I said something about how things are "generally", and your reply was something about how the OP didn't say something about her personal situation (i.e., the opposite of "generally").

Even if you have insurance on your phone, unless it's in the first 30 days, you are probably going to get a refurbished phone as a replacement for the one you last, broke, or it dies on it's own. The only way to know you will get a brand new replacement is to go buy a new one yourself. I speak from experience, cell phone lost on USS Enterprise, cell phone in pool, cell phone from hand to floor, now in 2 pieces. Each time the replacement was not the same model, nor was it new. This is with Verizon. Your carrier may vary.

Agree- getting a refurbished phone is common practice.
 
with electronics it is common practice to receive a refurbished replacement after a certain time period .. like a month or so. I'm usually fine with that as long as the refurb is in good working order and looks decent. If it looks banged up I'd call them and tell them you want one without the cosmetic defects.

While you purchased it new ... it wasn't new when it broke. It was almost a year old.

The company I work for (also electronics) fixes items under warranty, should the item not be able to be repaired (which has not happened the entire almost 9 years I have been there)to perform within manufacturer's specifications it will be replaced with a similiar model. We can not even guarantee its going to be the same exact model that is the replacement, its just not always feasible in our industry. When you receive the replacement the warranty does NOT start over at that point, you still have the remainder of the warranty for the initial machine purchase

We are not reimbursed from the manufacturer for our labor and very often not for parts either, its all just part of being an authorized dealer for our products :rolleyes:

Interestingly enough, we just returned from picking out a new item that was a replacement under warranty.

Four and a half years ago we purchased a DLP HD TV. It was the floor model so we chose to spend the extra $400 for the extended warranty. A few months later, the original light bulb burned out so they replaced it under warranty. Now, within a year of getting the TV we noticed a loud buzzing noise, but thought it was just the fan. We found out about 4 months ago that it is a particular part that was causing the problem and it was a common defect. I called for service and the tech came out, confirmed the defective part, and ordered it. Saturday, after waiting more than 3 months for the part to come in, I had finally had enough so I called the warranty company and basically said that 3 months was long enough to wait, and they either needed to confirm that the part would be available shortly or bring us a new TV. I was pleasant, but I wasn't backing down. Long story short they called yesterday and said that the replacement had been approved. They were replacing the TV with a 52" Sony Bravia LCD, or we could chose another TV that was the same price or lower than that model. We chose to go with a smaller size (52" is too big for the room it is now anyway) but upgraded the model to two models higher in quality than the one we were offered. We chose a 46" Sony Bravia something something VE. It has a higher resolution and a few more features than the larger model. The best part was it was actually $200 more than the one we were offered, but on sale for the same price! We paid a whopping $10.70 for some government fee to recycle the old one (which we get to keep, by the way, so it will go in the basement for the kids to play video games on...all of a sudden that buzzing sound isn't so annoying!)

So, I guess the short answer to your question OP is, it depends. It depends on the warranty that came with the item you purchased. Our warranty said if it couldn't be repaired it would be replaced with a new one. They no longer make the type of TV we have, so we lucked out with a new LCD. If your warranty said you get a new item, then it should be new. If it says they can replace it with a refurbished item then you may be out of luck.

What a one year warranty means will very greatly depending on the industry, the product, and the manufacturer. Many times a one year warranty is only on parts and not on labor. Many times it means a defective part will be replaced with a "like alternative". Sometimes the replacement is new, sometimes refurbished, sometimes it isn't replaced at all and is just repaired.

Think of a car. If my radiator blows up after 10,000 miles I am not getting a new car, they are fixing only the defective part. Many electronics are like this. I had a DLP TV that had a board fry while under warranty, I didn't get a new one, they came out and replaced it.

Electronics in general have warranties that very greatly. The only way to know what you are entitled to under the warranty is to read it.

In the OPs scenario I would be fine with a referb or even a repair of my original phone. In many cases a refurbished electronic is in better working order than a new one. It had hands on care and was thoroughly tested as opposed to stared at by someone in China as it passed on an assembly line (I admit I am assuming a competent repairman was employed). My issue would be with the beat up aspect of the phone. A like new referb is fine but one that was kicked down the driveway before the referb would not be.
 
my blackberry just took a big one last week...stopped making sound, I spent 3 hours looking for it a few days ago because I couldnt hear it ring lol anyway it is about 8 months old so they sent me a referb one, which is fine it looks brand new and it works! I had a crack in the screen of mine also so the whole they sent me is alot better so I am fine with it.
