OHIO DUI/child support questions

My brother is making me crazy!

Long story short...he's 34 yr old, 5 kids with 4 women (behind in child support on all), living rent-free with mom (again), alcoholic-all while riding a brand new, expensive, harley.

he got a DUI in andover on friday and they found a warrant for him in another county, for missing a hearing on back child support. andover is holding him until the county with the warrant picks him up to take him there for holding.

my questions; he refused to take the breathalyzer, isn't that an admission of guilt? what are the consequences for a DUI in ohio (his first one, amazingly)? what about missing that hearing; he is at least $20,000 behind in child support on 3 of 5 kids; what will they do with him? btw, oldest child was killed in a car accident 1.5 yrs ago at age 16 and he is still $8000 behind for her. he stands to receive a lot of money in a wrongful death claim, expected to be settled next month. oh, and he drives truck for a living; will he lose his CDL with a DUI?

sorry for all the questions, just trying to figure out what my mom is facing now, as she tries to help him-not understanding that it's not really helping.

Don't know about the child support issues - but I can tell you that it is most likely that he will lose his trucking job because of the DUI. That's a big no-no for any CDL holder!!
 
I am not an attorney, just a paralegal. He will loose his license and have to pay a fine. However, the warrant and child support issues will complicat his situation. Not sure how bad that will become but he may end up doing lots of community service. If he is a Plaintiff in a wrongful death suit and awarded any judgment, Child Support Enforcement Agencies will get first grab at the funds. But that it will depend on if any of the moms know about the suit and are able to file the information with their respective agencies.

He will most certainly loose the trucking job as Pam indicated. As to being re-hired again in the trucking business somewhere else, it could happen. DH works for a trucking company here and there are times they are desparate for drivers (unfortunate for the rest of us consumers and drivers).

Truly lousy situation. {{HUGS}} for you and because you have to deal with such a brother.
