Notarizing Closing Documents for Aulani

So.....closed on Aulani points on April 6 (allegedly). Deed is not recorded yet and now I'm hearing something to the effect that both buyers and sellers have to have closing documents notarized. I wasn't asked to notarize and my title company made no mention of this (not one of the big title companies). Not sure if that's because it's a small contract. Should I be concerned? Hoping someone here may have some insight. Thanks.
 
Correct. The [interval conveyance] deed needed to be notarized when signed. It should have been pretty clear.

Which broker did you use?

Yeah...I didn't have a doc like that. I don't have enough posts to post the broker link, but I'm going to email her tonight.
 
Unfortunately, I can't help but think about the story Brian Noble recently brought up a couple weeks ago about the scam seller.

I assume you trust your broker and title company (and at this point, it's all you can do). Fingers crossed it's just a simple mistake; though honestly this doesn't seem like something that would be missed if they were at all experienced with Aulani.

Yep it's the only one of the DVC properties when resold also requires the buyer to notarize their docs as well. I only figured it out when I bought my own resale Aulani contract.

^ is my understanding as well. I have Aulani resale and direct.

I'm a little concerned honestly. However; my broker is one of the big-ish names and I double checked all my correspondence with her to make sure the name, address, phone etc was correct for the title company and I did talk to the title company at that phone number at the time of wire transfer....so hopefully; they made a mistake and are not crooks.
 
Update...heard from my broker today. She stated that the deed recorded on 4/11 and the buyer notarizing is only required if there is financing involved.
Deed hasn't recorded on the Hawaii BoC website yet, but it does appear that Disney batches them as the last DVD entries are from 3/31. Fingers crossed.

We did not finance, and had to have documents notarized as the buyer.

Maybe something has changed?

Gosh...I hope so. This broker does a ton of Aulani so I don't think she'd mess this up. I'm going to be at least mildly anxious until these points post to Disney....hoping I didn't wire transfer to a Nigerian prince.
 
I’ve always read that Hawaii required the buyer to get the doc.s notarized even when they weren’t financing (when there’s a mortgage involved the mortgage doc.s need to be notarized no matter where the DVC is located) but here’s another thread where an Aulani buyer didn’t need to notarize https://www.disboards.com/threads/does-aulani-resale-need-notary.3909496/.
OP please keep us posted, perhaps there are nuances to when Hawaii requires a notary or perhaps the procedure/statutes have changed.

Thank you for posting this! Same title company as the two other buys who didn't need a notary. Also had title insurance. Exact. Same. Scenario. Since there didn't seem to be any follow up - I presume their points went through ok.
 
I currently have an Aulani resale contract in ROFR, with the same title company. Following closely.

Interesting. I bought an Aulani contract last year and did not need to have the documents notarized. We have notaries in the office, and it would have taken a minute to do, but I know I did not do it. My contact closed and my points loaded, but now I’m curious!

Yep...I'm still waiting on this one. I closed 4/6 and the deed recorded 4/11 (allegedly; I can't find it on the Hawaii Board of Conveyances site and Disney Member Admin doesn't show it). My title agent is MIA...hoping to hear from the broker. I'll update as I hear more.

Not financing this one either, but this one has a bunch of documents plus notary. The other was literally two pages; sign here and here. I have no idea.

We purchased with Disney Visa directly from Disney and had to do a virtual notary.

Would be interesting to hear what that other broker and title company’s takes are on not needing a notary.
