not happy!--resale closing

I am not happy about my resale purchase through the Timeshare Store. I signed the contract back in December--finally get the package in mid Jan.--to close by Jan. 31 through TimeShare Closing Services, Inc. The contract we are purchasing has 60 points that expire on April 1--so we were going to try a weekend get away--Broker knew that the 60 extra points were important to us. Well, even after paying extra for a quick close--nothing has happened. I called MS today(they were very helpful!) to see if we were in system yet.

We were not--they had the contract, but not the deed--so we can't book the weekend or our summer vacation. MS said they would check into it and call me back. About an hour later, TimeShare Closing Services calls me--the deal still has not closed! The seller did not sign everything correctly. They have just now sent the seller corrective documents. They were sorry that they had not called me! Yet for two weeks they had my $18,000 sitting around!

Sorry to be so mean, but this would be grounds for dis-barring a Georgia Attorney. That's what Florida gets for using title companies.
 
Sorry to hear that you are having all these problems in getting closed on your resale.

We used A Timeshare Broker, another resale broker that handles DVC resales and we closed in less than 4 weeks. We had banked points as well that we were excited about using immediately. We had good communication with our broker and she stayed on top of the attorneys and disney to make it happen.

Florida is very seriously a third world country in many respects. From the hospitals and the way they allow anyone and everyone to have mass gatherings for visitors, to finding a professional contractor, to closing on a house. Everything down here has the banana republic feel.

When I first mooved down here three years ago, the entire Miami government, mayor, police chief, city supervisor, like a dozen people were all indicted, arrested and thrown in jail. Some of them flew the country, most are still pending....and last weekend, our new mayor spent the weekend in jail for throwing a teapot at his wife, he was actualy running the city from a jail cell.....wow, talk about third worldism, its alive and well in Florida, South Florida especially.

where did you find your resale? My husband and I are seriously considering a Boardwalk resale and the only resource I know of is the one streaming at the top of this page.

Any info would be appreciated.
 

I think this is important info for the board. I know that besides having the contract we wanted, Jaki(A timeshare Broker) also seemed able to close more quickly. Contract to closing in 2 weeks.( It helps to have the $ available so you can send the cashiers check immediately). The Timshare store seemed to be set on amount of time-3 - 5 weeks. However, in the above case, it really wasn't their fault that the seller made a mistake, that seems to be an unusual situation. I do wonder why TTS can't rush a closing a little better?

Sorry to hear about your problem, fellow Georgian. I recently closed two resale contracts through Timeshare Store and the Timeshare Closing Services and had no problems. It took four weeks on each from the day we signed the contract to the day we received our deed in the mail. I got my membership cards from Disney before my deed arrived. I'd at least ask for a refund of your expedited closing fee, since you apparently didn't get that. And, tell your broker how upset you are. Maybe he/she can do something.
 
I bought a resale BWV, from The Timeshare Store. They were great, I dealt with Shontel and I don't remember who at TS Closing. One month start to finish and I was done. Unfortunately, we all can't be perfect all of the time. Sorry it worked out that way, but I know it's not like that all of the time.

It sounds like there may have been a few problems - the largest of which was probably with the seller. There's not much the broker or the closer can do if the seller refuses to cooperate or return documents in a timely fashion, though it sounds like the closing company should have done a better job keeping you appraised about what was going on.

We had a small problem with our resale closing as well; first the seller didn't correctly state the status of the points (some of them were banked from the previous year), and secondly the resale was a result of a divorce, and so the paperwork got held up because of that. When the broker found out about the points, they called us right away - we had to nag the closing people about what was going on with the actual closing (which was when we found out about the delay because of the divorce).

All in all though, we were very happy with our purchase with the Timeshare Store, and it's unfortunate to hear that you've had a few problems. Hopefully things will get worked out.

Ok, I am a little less angry, and I know more of the story. The closing date was Jan. 31. The sellers did not get documents back until the 5th of this month. Why no one(realtor or closing agent) did not call me when the documents were not in hand on the 31st is beyond me. The seller's ex-wife (remember Florida is a common property state) did not sign on the documents correctly. They got her corrected documents on the 9th. Hopefully, all documents will be in hand on the 13th.

Up to this point, I thought all was going well. Although I am saving a little money, I know that if the deal is not finished correctly in a few days--I will be going direct to Disney. There are risks to the resale market, and I have been delayed because of these.

By the way, are you sure that you live in South Florida? Sounds more like my former home: Washington, D.C.

Look for resales on ebay. Just picked a 350 point Boardwalk resale. No 15% sellers commission either for you owners who want to sell.


 
Ask the broker to ask the seller to make a ress for you that way by the time you get the paperwork you will have a ress already.
 
DVCER97, no, can't do that anymore. In what was generally considered a move to make resales less attractive, Disney announced over a year ago that any reservations that are made will be canceled when the contract is brought before them for transfer.

I don't think you can do what dvcer97 suggests. You can try, but I've heard that DVC now cancels all outstanding reservations on a resale.
 
I purchase a resale from the timeshare store and everything went smooth although the seller was in Austraila. The brokers who handled my transaction were Shontel and Kristie although the latter is no longer working there. Also, I have seen some resales at the BWVs on E-Bay. The most recent was for 300 pts. and it appeared as though the seller would have accepted $58 per pt. The auction closed and there were no bids, which surprised me. Moreover, I have seen through the tug ( timeshare user group) resales. There are many websites which can be accessed through yahoo or any other search engine, which I have seen resale albeit not many. Good luck! I am sure things will work out!

P.S. Keep in mind MS has been very good to work with and if they know you are a new member I think they will make every effort to accomdate you
 
The agent assured me that by Monday everything would be fine--still no calls about where the transaction is. I call the Timeshare Closing Services, Inc.--and only get voice mails--even on their reception extention. I hear that alot of you have had good luck with these people, but both the broker and closer don't get good marks with me.

Any idea what I should do? Am I going to have to sue to get my money back? I am desperate now!
 
I would be very cautious about buying a resale on Ebay. I have been taken for a ride on items much smaller than a timeshare, and I wouldn't want to risk it. I quit using Ebay after I had two transactions over the course of a year result in me losing about $1100. I sure wouldn't want to buy a timeshare that way! :eek:
