Non Compete clauses / contracts

Makes sense and that is consistent with my experience. ::yes::
 
Noncompetes are pretty standard in my industry (insurance). Mine is if I leave the company for any reason I cannot contact any of my company's current customers for one year. That's it and apparently it's hard to enforce considering how many former agents blatantly have gone after our customers. I know they sent out a letter warning them to stop, but heard through the grapevine that's all they plan to do.:confused3
 
I have a non-compete clause in my contract, but it is just for a 1-mile radius of the hospitals I currently work at. If I am outside one mile then it is OK. I specifically asked about when I signed and would have refused to sign one that seem truly restrictive. It doesn't even cover every function of my job, just one particular arena.

I would encourage her NOT to sign that or try to negotiate it.
 
At every place I've ever worked, either the employer sued ex-employees for non-compete violations (and won) or my co-workers were being sued by previous employers for violations (and they lost). I've never seen a case thrown out and the non-compete always held up.
 

My husband is a consultant in the IT field. He has always been presented with non-compete clauses from every client he works for. For 20 years, he has always told the clients that he will not sign it, if they don't like it, he will go work for another client. No client has ever shown him the door for refusing to sign it.
 
I just discovered that except in specific circumstances, non-compete clauses are illegal in California. I had to sign one, but my employer is not living up to expectations with hours (as in I am only getting 4 hrs per week with the expectation of 15-20). To find out that the contract is not legal is pretty cool for me! (it is an out of state company that just opened franchises here, so perhaps the out of state lawyers were unaware of this CA law)
