Neighbor trying to knock down our fence

Sorry op, that you are having to go through all this mess when you are the one that is 100% in the right. Some people can really be pains and cause us to take legal action when we'd far rather not, and just be left alone.

Glad you finally have someone on your side and hope things continue to work out. Hopefully he 'won't' end up being your neighbor!! :sad2:
 
Oh course I can update :)

So the town came and shut him down. I was told that the only way he is allowed back onto his property is if he's there to fix his violations and make it right. He hasn't fixed our property, but the town told us that he will soon, and I know he has to fix ours before he's allowed to start working on his house again. I'm fine with that for now because we have the town on our side.

However, we did get a notice before summons in the mail a couple of days ago that told us we were in violation with our shed being too close to the property line. It has to be 3 feet from the property line and ours is 2 1/2 feet. I called the town law department, told them I had the land survey with the shed on it, and faxed it over. I figured I could just shave off 6 inches from my shed and fix whatever violation we were in. The town called me back, thanked me for the documentation and told me that he wasn't about to split hairs over 6 inches. He didn't realize the builder was reporting me for something so petty. I guess he was trying to get back at us for reporting him? The town told me not to worry about it and we are no longer in violation.


Other than that, I still have to see him when I go outside, but I'm lucky he hasn't tried to say or do anything to me!

However, if it were me, I would fix that 6 inches immediately. The town told you they wouldn't quibble over 6 inches. What is good for the goose is good for the gander. I wouldn't want the town to tell the builder, well we won't quibble over 6 inches (of your property) when he is not 100% within compliance.

I would want the ability to use the fact that we were 100% within compliance to defend my property. It is a lot harder to complain about somebody else being out of compliance when you are not in compliance either.
 
I wouldn't be surprised came onto your property to measure where your she'd is.

A suggestion, post your property with a no trespass sign. If he comes on your property again without permission it will cost him.

I believe in our state the penalty is a fine and/or jail.
 
I would also fix it in case the issue is raised again. The next time the city staffer who reviews it might not be so lenient.
 

If I were in OP's shoes, I would not worry about the shed. Fix things if it comes up again. But, I would get a permit for anything else I did.
 
I'm happy that the town recognizes this builder is wrong. We all knew it but........keep us updated, we want to know if and when he fixes what he demolished. So happy for you!

Can the town force him to post a bond equal to the cost of repair? Then you could fix it and bill him. If he refuses to pay then the bond will pay it off.
 
OP I was thinking about you and wondered how you are doing with your new neighbor? Hopefully all is well and put back in it's place?
