My guide told me payments aren't due...

If it's not a big deal, and you're going to pay it off anyway, is really worth getting upset at your guide?

In the past precontruction contracts didn't close until close to opening. The FL laws on certificate of occupancy have apparently changed and for the first time DVC is able to close initially. When you close, you have to start paying or pay the balance which even is the issue. Dues are calculated from opening, now from when you sign in this situation.

Can you switch guides? I think there was a thread on here where people had guides that they loved, and they named them. Maybe switch over to one of those, because it sounds like the one you have isn't communicating clearly with you.
 
Now you have me worried. We just added 100 points at AKV this week with an August UY. We took the developer points. Our guide also told us that no payments or maintenance fees would be due until August.

From what I've been told the state of FL changed the certificate of occupancy laws and they will be able to close much earlier. I was told final payment would be about 2 weeks from when I sent in everything. I'm sure just long enough to make sure we'd cleared the 10 day right of recision requirement. Dues won't be due until the later of your use year, when your unit opens or when you close. In this case your dues should start from 1 Sept.
 
When you think about it, it's a wonderful business deal for Disney. Put out just enough information to get everyone excited about buying. Don't have a model or room layout info, just a point chart. Offer the Tapestry to the first 150 to buy. On 2/1 they had over 150 sold, change the tapestry rules to include all sales in the month of February. Have the members start paying several months before the first unit is ready in September. Only offer a unknown number of units in September so you can say that it's officially open. Keep selling more units so the entire project is paid off prior to completion, just like SSR.

Make me wait to buy points at CRV. ;)

Until AKV, DVC would have waited and closed within about 30-45 days before opening. With AKV things are different. I have been told it's due to the certificate of occupancy rules, that they have changed allowing an earlier closing. There's no question something has changed and that info makes sense.

The rules may have changed, but my point is they are Disney's rules. Sure they want to close early. The sooner they close, the sooner they can receive payments.

The certificate of occupancy is a state rule based on FL Statue 553, not something Disney would have direct control over. Not that it matters in this case but this would increase the risk on any new resort in case the developer took a hike.
 
I've already closed on my AKV contract and my first payment is due in May which I knew, but what bugs me is it now says I have an annual dues payment due for AKV of $174. My UY is Oct and we purchased 150 points. I was told dues werent due til the end of the year. Its only $174 but I feel we were mislead , and to add to this when I called MS and asked about AKV opening and the booking dates she told me there would be a very limited amount of rooms available come Sept and if I wanted any chance at a room to make sure I called right around the opening booking date of May 16th.
There will probably be an influx of points for rent towards the end of this year many people will either have to bank their 07 AKV points or use them at another resort and once the public has a chance to purchase and use their points it will only become worse until AKV is complete.
 
well, since you bought AKV points, you will have a month or more to make ressies before anyone else can. Besides, they can't sell a million points, and then make only 1-2 rooms available, it doesn't work like that. They usually make more rooms available than points sold, so it's not too hard to get a ressie at all.

Did you think this only happened to you? Think again--a significant portion of the 80,000 DVC families have bought points at a new resort, and yes, we were sure we couldn't reserve a room at our own resort, and we were already paying for our points, too. It turned out to be no biggie, because we all got our reservations, and you can always go to other resorts, too. The bigger issue turned out to be that all of you wanted to come to our resort, so it became mandatory to make ressies at 11 months. :sad1: Did that sound b****y? Sorry-- I haven't had my coffee yet.

Because DVC has changed how they do it, one doesn't have the choice.

I've never experienced anything like that from my guide. I'd request a change of guides and clearly explain why. You shouldn't be argued with or feel nervous about calling. After all without people like you they have no job.

As for paying now, I'm on your side. It did NOT work that way when I added on at SSR and it did not work that way when I bought VWL before it opened.

Oh yeah, I made ressies before I paid also. One had nothing to do with the other.

I wouldn't be too sure it was Disney. Florida timeshare laws are very specific, and Disney has to follow those laws like every other timeshare. Disney surely could delay closing, but I don't think they could "move up closing" if the FL law didn't allow it. It was always to Disney's advantage to close as quickly as possble, so nothing changed there...what changed is their ability under the law to close earlier in the construction of the timeshare. I'm pretty sure all the other timeshare companies (and there are tons of them in Florida) were in favor of this change and achieved it through legislation at the state level.

I would agree. There had to be a state mandated change to Timeshare law. DVC simply can't change things to suit their needs if it against the law. DVC, if nothing else, is above board with their dealings as far as I'm concerned.

I've heard or seen nothing to the contrary actually.

I'm now confused about the dues. I have a December use year and didn't take the developer's points. Shouldn't my dues "begin" in December 2007 for a 2007 use year? I was told they would be pro-rated and begin with the month of my use year. Is this not the case from what MS has said?
