Moving Out Question

We sold our home, and we move out next week. In our contract, we stated that the dining room curtains will not remain with the house. Would you assume that means that the hardware/curtain rod will go as well, or would you consider a curtain rod as a "fixture" that would stay with the house?

I would assume the actual curtains would be gone but the "installed" hardware would stay.
 
Unless stated otherwise, I would assume the hardware stays. You really have to be specific in your contract.
 

If the contract specifically says "curtains" then I would expect that only the curtains themselves would be removed, and the hardware would remain. If it said window dressings, window accessories or something more generic like that then I would assume you meant everything around the window, including the hardware, would be removed.
 
I have always taken the hardware that the curtains hang on....but have also repaired and painted the wall.....
 
When we were buying our home, the realtor told me that unless the contract specifically stated otherwise, anything that was screwed down or nailed onto the walls was considered a permanent fixture and is supposed to stay.

Given that, I'd say that your curtain rods, blinds etc stay, you take the curtains.
