Pre-trial hearings began yesterday and lasted well into last night (ending at approx. midnight).

We were told to be ready for the trial to begin on Wednesday.

We received a phone call today letting us know that that the man who hit and killed my Dad took a plea bargain to a lesser charge of DUI.

His license will be suspended for 1 year, he will have two years of probation, he will have enforced drug and alcohol counseling and he will have community service.

He will also have a felony conviction on his record and if he breaks his probation (and he will), he will go to jail.

While we would have wished for a harsher sentence of losing his license for life, we have to accept that this is the end. The final decisions have been made.

There is a certain relief in knowing that our part of this story is over.

It's time to let this go and start to get on with the rest of our lives. We all need to move ahead.

I would just like to tell you all how grateful we are for your outrage, your letter writing, your friendship and your support.

My Dad would be very pleased to know that you all stood by him through all of this.

I am glad to see that some justice was given to your family. While it will never bring your father back, at least you know his death isn't being considered insignificant. Hopefully, this young man will be able to get his addiction under control before taking another life. :hug:
 
Glad you have some closure. Your family is in all of our thoughts.

I can't relate to anything that has happened here, but it seems moving on is in your families best interest.

Knowing you like I do I'm sure your Dad would be very proud of what you've become; a kind-hearted person, a gentleman, and a dear friend to all of us.

Thank you for sharing the results with us. I know it wasn't the end result you hoped for nor which seems appropriate under the circumstances. Even so, I have seen too many folks not be able to approach similar circumstances with the equanimity you have shown and who, in the end, are unable to say what you have said here, compounding one tragedy with another.

While the sentence he got is not what he deserved, you are right it is time to open a new chapter in your life.
I am also thinking just as you are that this man will break his conditions.

You are a good friend and I am so glad I got the chance to know you, and I am sure your father is looking down feeling an immense pride in you! :)
 
Kevin, I'm glad you and your family were able to get some justice in this, and hope that this will help you along in the healing process. Your strength through all of this has been very inspirational to me, and I'm sure to others as well. :hug:
 
The re-opening of the case may have saved another life as the man now undergoes enforced drug and alcohol counseling. Glad your family has some closure; hopefully your mom is doing well - take care.

I have to say I'm very impressed with how open you've been with all of this, sharing what I imagine was surely one of the most difficult things you've ever had to go through. You've been a real example for all of us on how to show immeasurable grace under pressure. Take whatever solace you can in this eventuality and know that we are behind you all the way. :grouphug:

Kevin, glad you guys are able to get some sort of closure with this case, albeit less severe than maybe warranted.

You know you will always have our support. I'm not really one for opening up very much but I know if I did the podcast board in particular is a tremendous place filled with fantastic, caring people.

Kevin my heart is with you and your family. I hope this give you closure knowing at least he didn't walk away without any justice.
 
Kevin being in law enforcement I can tell you that you are right, he will break his probation. Here in Massachusetts we have problems with people who lose their license for life, but just keep driving anyway. Little or no punishment from the courts.

We can all understand the disappointment in pleading to a lesser charge that brings the possibility of regaining licensure. I suspect that you are right that he is likely to violate the conditions. That being said, this does present the opportunity to come to some level of closure. Love and prayers to you and your family as you move to the next phase.
 
Kind of a newbie here...but just wanted to say I am very impressed on your outlook on the situation. You could be bitter or vengeful but you choose not to let this person( who is clearly not worthy) continue to affect your life in a negative way. I don't know if I could be strong enough a person to do that.

Whether you are religious or just spiritual in some way...I truly believe in Karma. What comes around goes around.

I will keep you and yours in my thoughts and prayers. I think you are a truly great person for overcoming and moving past such tragedy!
 
Kevin, I'm so impressed with your choice to try and accept this. I know it is probably one of the toughest things for you and your mom to do but you're right. To allow yourselves to let this consume you or use up all your energy would only being adding to the crime and not something I'm sure your father would have wanted.

Kevin, I too am glad that the DA did decide to persue the case against this individual, I'm saddened but not surprised at the outcome but at least as you said it is an end. I do hope that when he breaks his parole it won't be at the expense of another innocent life. My thoughts are with you and your Mom and the your family. Take care of each other.
 
Oh, Kevin, I am not sure why, but this brings tears to my eyes and I can't stop crying.
So sad that you have lost your father in this way. Angry at the way your father lost his life.
Still, you have found a way to move forward.
