Max Capacity Rules

I know different companies/individuals have different policies, but I wondered what people here had encountered. Here's my delimna and question...

We have 2 WH homes rented for a trip. The websites say they sleep 10-12 on one and 12-14 on the other. The high side being if someone sleeps on the sofa bed in the living room. Anyways, we've got 15 adults, 4 kids old enough to sleep in beds by themselves, and 5 that will be sleeping in pack-n-plays. That makes 24 people which is 2 short of max capacity according to the owners. We now have another family of 4 interested in going and while we have the available beds, I don't know if the owner will allow it. I'm waiting to hear back from the owner now, but I was curious what you had encountered.

I originally looked at getting a place from one rental agency who said that the numbers listed on the site were max capacity because of fire code. It didn't matter how many small children/infants you had.
 
Hi.... if the owners site says sleeps upto 12 then that is the maximum number of guests no matter if its 10 adults and 2 infants (and it leaves the sofabed free).
Be warned that the Division of Hotels and Restraunts Inspectors do visit the estates and can access the villa if you are in, no matter if you are the guest or owner and check occupancy, licenses displayed etc.
Also if you have told the owner there are 10 of you and another 2 arrive and you dont notify the owner(insurance purposes) you could worst case be evicted for breach of occupancy.
You should always speak to the owner as they will always do what they can to help there guests as they hope that you will return in the future or recomend there home to others...
 
No doubt I'm notifying the owner of everything. I'm waiting on a reply from one of the owners now. I was just curious as to what you all had enountered. I'm not crazy enough to attempt to have more people that what we're supposed to. The people who didn't get in early enough will just be out of luck if that's the case.
 
I think they are likely to be out of luck. The maximum capacity is part of the lodging's licensure with the county.
 

If they are, then so be it. I'm not about to risk my vacation for someone who got in too late. I'd love for our friends to go, but we'll see what the owner says.
 
They will be risking their license if they take more than the maximum number .
 
Maximum capacity, per the hotel license in Osceola County, is ALWAYS the number of bedrooms x 2, +2 extra if the home has a sleeper sofa.

So... a 3 bed home can sleep max 8 (with sleeper sofa).

4 bed = 10
5 bed = 12
6 bed = 14

Doesn't matter if the owner tells you more are allowed, it's not legal, and they can get in trouble, and you can be evicted if caught with more than that number sleeping there.
 
There are smaller rentals available in WH, condos and townhouses. I wouldn't worry about it if they can find something else in the same community.
