Legally, don't count on Hawaii as DVC in Multisite timeshare plan

So I'm signing my paperwork for my 100 BLT contract and I'm signing all the documents. One paragraph caught me off guard in the purchase agreement. I'll give you the exact wording and let you determine what it means:

From Purchase Agreement:
"Disney's resort on the Island of Oahu, Hawaii is only a possible component site which may never be added to the Disney Vacation Club Multi-Site timeshare plan. Do not purchase an interest in a Disney Vacation Club Resort in reliance upon the addition of this component site."

We had the same wording in our paperwork for not yet built resorts back when we first joined in 2002. I think my original VWL paperwork mentioned not counting on BCV.

ya, nothing to worry about. They need to cover there butts incase something was to happen. There just saying dont buy dvc in the hopes hawaii will join up.

The same language has always been included in the documents. We purchased in 1993 and had the same legalese about VB, HH and BWV in our documents.

Legally, until a new resort is declared into the DVC program, it is not official and the legal language is there to define that purchase is not dependant on any future resorts being added.

My BWV papers from 1999 has the same wording about VWL. It just leaves room for them to change their minds about completing construction or selling it before declaring it part of DVC. They did announce Eagle Pines and then changed their minds, not sure if ground was ever broken. So it not unpresidented that an announced DVC is not completed.

It's also like the wording that there are no guarantees that the Disney Theme Parks will be there forever and that your resort may or may not always be part of DVC and other resorts may be added and come off as well.

I think it is refreshing that Disney has that information in their paperwork. It is better than over promising and under delivering.

They have to cover themselves, it is a sad statement to our society that they do have to for something like this. The reason is that someone could promise them HI or they could hear it as a promise even if it was not. I agree with Jason, glad to know they're being honest.

You'll get a similar response if you ask your guide about a rumored new DVC location. They can't confirm or deny any rumors, because you could, if for some reason you decided to back out of the deal, argue that based upon what your guide told you, you bought DVC with the expectation that they'd be building at (fill in the name of the rumored location) and because DVD has not built there, they've breached the contract.

When we first bought into DVC, that same sort of wording regarding buying in if you were expecting Eagle Pines to be built was included.

It was officially announced with plans and pictures and published in the VM magazine. Same for EP.

Not as sad as McDonalds having to put "Coffee is Hot" on their cups. People have become very litigious so companies have to cover themselves.

After reading more about that case, I'm fine with the warning. No one should have to get skin grafts from the 3rd degree burns they got after spilling coffee on a lap...the coffee should NEVER have been that hot...



Lawsuits or not, it's GOOD wording that makes sure that people aren't buying x to get y, when y could go away at any time. Look at what just happened with parking; if someone bought in so they got free valet, their whole reason is gone now. You have to make sure you're buying x b/c you would be happy with x if everything but x went away.

And the paperwork that I signed for AKL didn't just say that we may not see a giraffe or zebra from our balcony like the pictures in the brochure. It said they could remove the animals at any time, and I shouldn't buy the peoperty with th eexpectation that the animals will remain on the savannah.

That actually gave me some pause.

DVC is inserting that language because it doesn't want you making the decision to purchase DVC based on the potential use of your points at a DVC in Hawaii. So, even though a Guide can spin, spin, spin about how exciting a DVC in Hawaii is going to be, the contract is negating all that speculation in case the resort doesn't end up in DVC.
