Thank you, Newtodis. I was curious to the exact date of the last contract signing myself. I didn't read it all but it appears that April of 08 was the last contract and 4 additional amendments were added by either party since then.
So it looks like they signed the last contract before Jon just wanted to be Jon. So I was mistaken with that, sorry all. :flower3:.
So, do we assume they didn't have to re-sign the contract when TLC exercised their option to go ahead with season five in February 2009?
 
He did. Kate worked a double, 7am-11pm, on Saturdays at a dialysis center and Jon was with all eight kids. It was said that he was alone with all eight kids before she was. He also got the twins ready each morning (or they were left on their own) while Kate slept in and the tups stayed in their cribs. She didn't work labor and delivery after the tups were born, just the weekend shift near their home. Which of course sounds logical. When the tups were less than a year old, they told most of the volunteers to scram. This is when Kate was lobbying for the state provided nurse to continue after their first birthday. For a short time between the volunteers and the nurse leaving, and the show starting, they seemed to have done it mostly alone. This is when Carla (old family friend) and her daughter Ashley helped out. I think that is when Beth and her two older girls (Brittany and Kayla) introduced themselves and began helping with the kids. They along with the two Nana's are the ones Kate "could tolerate in her home."
By the time the tups were turning two, the show was becoming a series instead of specials and they moved out of the little house. Beverly and Janet seemed to have helped a lot the first three years of the tups lives. One of them (not the laundry folding one) use to come while the tups were taking their 3 hour nap and the twins were at school (they went to pm Kindergarten) so Kate could grocery shop.
As soon as the idea for a series was sold, Kate quit the nursing job and they moved into the big house (which isn't big anymore, by their standards!) by Jodi and Kevin. Jon was gone (as said above) about 12 hours a day until he began "working for Bob" because of his commute. I get the time mixed up, it has really flown. I can't believe the sextuplets are 5 1/2. I remember following the story and seeing their website when Kate was pregnant.

I can't watch though. I only get to see the promos.

Inside Edition was also there with Kate, or at least did a story on Kate.

All those shows (ET, Extra, Inside Edition) start here in about 30 minutes.

I'm pretty sure all Maria says is that Kate is doing the best she can -- I've seen a similar sound bite from her.
 

Do we know that they didn't pull permits that there were suppose to have? I don't understand..why, with all the years they have been filming, didn't PA prosecute them, if they broke the law?


I don't know the answers to any of the above. Before, Jon said they were not over filmed, and TLC listed very limited hours compared to the Child Actors in other states (and I don't know this first hand, just want a previous poster posted). Now he changed his mind, so which was the truth? Is he saying that to boost his chances of getting custody over the kids and their accounts? I don't know if they have been filmed in situations that the Child Actors in other states are protected from..didn't someone just post that nothing would have changed? I don't know how much is in their accounts and I have no idea if they got the 15% they should have gotten if they were in the child actors (the amount that had to be saved). So I guess, unless I get those answers I can't agree yet.

They show nekkid babies in diaper commercials and ads often. Sure--you don't see body parts that pertain to the baby, but you do get a glimpse of the tush from a sanitized angle.

Just sayin'.

I'm getting lots of baby stuff in the mail now--and ummm...yeah. All over the place!

They show commercials with potty training children who indeed are sitting on potties with their pants down.

Heck--they allowed balloon boy to stay on tv whilst he was vomiting. Not exactly a prime example--but it is real life.:laughing:

They show trauma shows with babies in much more compromising situations than any of the kids have EVER been shown. (sadly I saw one in which a 1 year old died. Very sad.)

Heck the poor kids in all those St. Jude's Hospital infomercials! Granted that is for a 'cause---but All the children are sicker than the one boy's constipation!

Let's see--they do show acting kids in interesting situatons often. Sure the situations are pretend--but they are permitted to be filmed (including movies in which young children are cussing in the film!) (Simulated barfing on one movie in which the poor little girl was shown topless as she was getting cleaned up in the bathroom--can't recall the movie title but it was about a bunch of divorced parents and had Paul Reiser as a dad and "meathead" from All in the Family as a radio show host).

So there are many things that children do that are permitted in the industry that have been shown IRL on J&K.

As for permits, the show is listed as a documentary and as such isn't covered in ANY state and that is the problem.


And *sigh* on PA child labor law--the only "loophole" is that they failed to get a work permit....which is an interesting thing for the state to ignore for all of 5 years.

It doesn't say that permits can't be renewed--it allows for work up to 44 hours per week and permits start when the child is 7. So the only ones in non-compliance are....Mady and Cara.

The only "loophole" is the absence of the term "documentary" which is what this show is classified as and the repeated use of the word "perform" which the children are not really doing though it can be argued "Coming up Next on Jon and Kate"--but I rank that right up their with reminding my kid to say "please and thank you".



(a) The Department of Labor and Industry is hereby authorized to issue special permits for the employment of minors seven and under eighteen years of age in theatrical productions, musical recitals or concerts, entertainment acts, modeling, radio, television, motion picture making, or in other similar forms or media of entertainment in Pennsylvania where the performance of such minor is not hazardous to his safety or well-being, except as follows:
(1) No such minor shall be permitted to perform after the hour of eleven-thirty in the evening.
(2) No such minor shall be permitted to perform in any place or establishment where alcoholic beverages are sold or dispensed.

(3) No such minor shall be permitted to perform in a boxing, sparring or wrestling match or exhibition or in an acrobatic or other act, performance or exhibition hazardous to his safety or well-being.

(4) No such minor shall appear in more than two performances in any one day nor in more than eight performances in any one week.

(a.1) In addition to any permit authorized by subsection (a), the department shall be authorized to issue special permits for the temporary employment of minors as part of the performing cast in the production of a motion picture, if the department determines that adequate provision has been made for the educational instruction, supervision, health and welfare of the minor. Unless the department determines that more restrictive conditions are necessary, special permits authorized by this subsection shall authorize minors to work as part of the performing cast for forty-four hours in any one week and eight hours in any one day. Time spent on the set or on location while on call shall be excluded from any calculation of the maximum number of hours authorized by this subsection if the department determines that adequate provision has been made for the child's education, supervision and welfare during such intervals. The department may restrict the number of hours which may be spent on call by the minor. The department may waive, in whole or in part, restrictions contained in this act and in any other act, on the time of day or night allowed for engaging in the employment authorized by this subsection, if the department determines that such waiver is necessary to preserve the artistic integrity of the motion picture and further determines that such waiver will not impair the educational instruction, supervision, health and welfare of the minor. Special permits authorized by this subsection shall be valid for a period of time not to exceed six months. An issued permit shall state that no minor, allowed under the permit to be temporarily employed, may be allowed on a set during, or may otherwise watch, the filming or rehearsal for filming of any sexual act. Nothing in this section shall be construed to supersede or repeal in part 18 Pa.C.S. §5903 (relating to obscene and other sexual materials) or 6312 (relating to sexual abuse of children).

(a.2) A special permit shall not be required under this section for a minor who participates in a nonprofit, educational, theatrical production if there is informed, written consent of a parent or guardian; if the participation is for a period of no more than fourteen consecutive days; if the participation is not during school hours; and if the minor receives no direct or indirect remuneration. All other existing limitations of this section shall remain applicable.

((a.2) added Dec. 21, 1998, P.L. 1242, No. 158)

(b) Rehearsals for performances as set forth in this section shall be permitted, providing the length of time and hours of starting and finishing such rehearsals added to performance duties are not such as to be injurious or harmful to the minor. Rehearsal time, if any, expected and the hours of starting and finishing same shall be set forth in the application as provided in this section, and the special permit issued shall state what rehearsal time is permissible.

(c) Nothing in this section shall be deemed to supersede or repeal any provisions of this act unless and until such special permit is issued for any such performance or series of performances.

(d) Application forms shall be in such form as shall be provided by the Department of Labor and Industry. Such forms shall be signed by both the employer of the minor and the parent or guardian of the minor, and shall contain the seal of a notary public and a statement that the facts as set forth in the application are true and correct. The application shall state what provisions are in effect to provide for the minor's educational instruction, supervision, health and welfare and the safeguarding and conservation for the minor of the moneys derived from such performances. No special permit shall be issued for any performance where there is no adequate provision for such educational instruction, supervision, health and welfare and the safeguarding and conservation for the minor of the moneys derived from such performances.

(e) Appeals of any decision under this section made by the Department of Labor and Industry shall be to the Industrial Board which will hold a hearing on same.

While answering viewer's questions during Monday's Jon & Kate Plus[/I] 8 special episode, Kate Gosselin made clear that she plans to extend her TV [URL="http://www.radaronline.com/exclusives/2009/10/exclusive-kate-gosselin-files-renew-nursing-license#"important]! important]career[/URL]. However, RadarOnline.com has learned exclusively that the mother of eight is keeping her options open and has renewed her nursing license.

In a document submitted on October 26, Gosselin seeks to renew her license which was set to expire on Halloween. For the $45 fee, her license would be renewed until 2011. While Kate is free to practice nursing if she wants to, before the next renewal in 2011 she will have to complete thirty hours of continuing education credits in compliance with the State’s regulations, a Pennsylvania Heath Department spokesperson told RadarOnline.com.

Before finding fame and fortune on reality television, she was a labor and delivery nurse at The Reading Hospital and Medical Center in Pennsylvania. On the show Monday, a reader sent in a question asking Kate if she would ever be a nurse again. She replied that she considered it a backup career and would return to it if she had to. I don't know how licensing works for nursing--but it sounded like she had to do it now or she essentially lost her license forever.

The previous contract was such that TLC had the option to shoot the next season (not sure how many) in addition to the dated part of the contract. The last contract expires on Feb. 2010. However TLC has the option to continue to invoke the exclusive contract they have with the Gosselins beyond that date if they choose to.

The way I understand it is that all television contracts are worded this way. It gives the broadcasting station the ability to terminate a show the following season if viewership is down or go ahead and order another season if ratings are good.

I have no idea. I couldn't find a video or article about Jon leaving the courthouse on Radar. :confused3

Jon Gosselin halted production of the show following an announcement from TLC that they would be renaming the show Kate Plus 8 and downscaling his role. Jon claimed an “epiphany” came to him out of the blue and that he realized the show was damaging the welfare of his eight children.

Maria is saying the same thing on all the interviews -- that she never thought to disinvite Kate and that Kate is doing the best she can right now, under the circumstances.

Inside Edition reported on the convention, too ... very few people came to hear Kate speak, and hardly anyone wanted an autograph, so she left early.
