Jaycee Dugard and the $20M Settlement Question

for the time being, the state controller is refusing to comply with the govenator's decision (did the same thing a couple of years ago).

the controller's office contends that it's illegal for the state to take this action, they don't want to get hit with the liability that could occur, AND their payroll system can't make a change like this.

That controller is smart. I'm guessing that many of the state workers are unionized, with a contract? And if that's the case, he is absolutely correct that what the Governor is proposing is illegal. It would never hold up in arbitration, and would end up costing the state SO much more.

one of the interesting issues is that the gov. is saying to exempt from this, all the union employees whose contracts were recently re-negotiated (and almost universaly with pay, benefit and pension cuts). the other union staffers whose contracts have not yet been settled (still in negotiations) are not being exempted under the gov's directive.

this looks an awful lot like he's trying to force those unions that have'nt yet settled into doing so by putting the employees in jeopardy (at minimum wage, not even considering the impact to their personal finances, the bulk of their minimum wage checks could be eaten up by their withholdings for insurance and mandatory pension contributions:guilty:). if they are one of the state employees that are already getting a wage cut due to mandatory furloughs i can't imagine what would happen if their "new" wages were insufficient to cover their insurance.


i had to speak with a cal-pers (retirement agency for state of california employees) rep. back when the furloughs started in and mentioned them to her-she said at that point they were starting to get flooded with retirement applications from state employees (figure-their pension is generaly based on their final salary, and if you get furloughed 4 days a month you can be looking at your final salary being reduced by 20%). i can't imagine the number of applications that they are receiving now.
 
I'm glad she is getting this settlement. She has been through so much, I'm pretty sure she able to hold a job, if she ever can.
 
I am soo happy she is getting $20 Million!!! The state of CA messed up by failing to protect her from a man that was originally supposed to be supervised for his prior history.
