I think Im gonna be sick!!!

Oh I hope you guys can say something to make me feel better because when I say Im gonna be sick, Im not kidding. We started planning our vacation early well at first we were gonna stay at a villa well my mom, dad, nephew decided they want to go to well after that we decided to stay onsite because my dad gets tired easy and it would be convienient for him to go back to the hotel via bus. Well I told the lady that we were going to cancel and she never really said much about it and that was that. Well she calls me and says its time for me to send the rest of the money for the villa and I told her we had canceled and she said I was supposed to send her a cancelation in writing before 10 weeks out and it was on my contract. I dont remember seeing that on there or I think I wouldve remembered that little detail. Well here I am soooo looking forward to staying at POR for the first time and now Im stuck with this villa AND even worse than that stuck staying in the same house with my nephew ( I know, that sounds horrid but ya just gotta know him ) So now what am I gonna do? PLEASE help me feel better about this. I keep telling myself that I will save a HUGE chunck of money but that dont seem to be helping matters any. :sad:
 
Maybe it's worth it to swallow the deposit and stay onsite anyway......don't know how much you already sent her. I would be careful if she has your credit card number though. Good luck. Hope you have a great trip anyway.
 
Well I had decided to swallow the depositwhich was 150.00 but now she's wanting the rest of the money which is over 700.00 whether we stay there or not thats why I think she waited till now to get in contact with me because its 7 weeks out and she knew if she called me earlier (supposedly 10 wks) about the "cancel in writing thing" I wouldve "canceled in writing" It just makes me furious.
 
How did you pay the deposit? And what does it say on the contract about paying "in full" if you cancel?

I paid the deposit with a check. And I dont remember seeing anything on the contract about paying in full if canceling. I keeping thinking I wouldve remembered something like that. Oh well........
 
Well unless she's an actual "business", I don't think she can just go into your checking account and get the rest..

Did you keep a copy of the contract?

Well, I know its stupid but I didnt keep a copy. I talked to her this morning and told her to fax or email me a copy of my "signed" contract and she hasnt emailed me nothing yet but I wont know about the fax till tomorrow morning when I get to work. Im usually really good about keeping up with that kind of stuff but this is one time I've slipped up. And Im paying for it dearly.

If you have an attorney, you could have them send the place a letter

how did you pay the deposit, hopefully you used a card, despute the charge, the company will have to show proof of the signed contract

They sound like they are full of s_ _ _ if you know what i mean, what type of place is this anyway, most places charge you one night if you cancel and that is within 24 hours, i would send them a letter not only letting them know you will not be stayin there but also file a dispute with the better business bureau, personally i would not pay them a cent, they are full of it
 
Ten weeks out for a cancellation! :eek:

I could see maybe losing your deposit....maybe......but to have the total due unless you cancel 10 weeks ahead of time! My goodness!

Sorry for all of the exclamation marks but this is that kind of post!
 
A reputable company would have immediately sent you a copy of the signed contract. A verbal cancellation should have been sufficient.

I would push the issue if you verbally cancelled 10 week+ out and not pay them a dime.

Don't let yourself be bullied!

However, if you receive the SIGNED contract and it does state that the cancellation has to be in writing, then perhaps you can kindly explain that you cancelled so long ago and they neglected to remind you of the written cancellation policy. You apologize for the mix-up and have no problem forfeiting the deposit, but based on your previous phone call, you've made other plans.

They're not going to sue you or anything over it... If it is a nice vacation rental, at seven weeks out -- during the summer season, they should have absolutely no problem re-renting it.

I think a 10-week cancellation policy is a bit much!

i so agree so much can happen in 10 weeks, heck i was still changing hotel and villa options up until 2 weeks prior-lol
 
Requesting cancellation 10 weeks out sounds excessive to me.

First, I recommend you send her a certified letter return receipt immediately stating your intention to cancel. Reiterating the fact that you verbally stated your intention to cancel on _____date. Start making a record of every conversation you have with her, time, date,etc..... You should also include in the letter that you require that she send you a copy of the contract and if she doesn't comply she will contacted by your attorney. See if she falls for it.
 
Most owners would simply keep the deposit if the booking was cancelled within this time frame .How did you tell her you cancelled by e mail? if so have you still got a copy of that ? If it was by phone then then did she send you anything requesting a written confirmaiton by e mail ? I would not pay her another penny until you have got a copy of your signed terms from her and if you don't get one then I don't think she has much chance should she decide to take the matter further.Does she have a web site as some owners have their terms listed on there for you to look at. Did you find her through a listing site as it may be worth getting in touch with the owners of the site and explain the situation and say you feel the owner is acting unreasonably and that it does not refect well on the site. Losing bookings is part and parcel of the rental homes buisness and I think owners that act like this do the rest no favours.Good luck let us know how it goes.
 
She send me a copy of the paper I signed today. Well on the paper that I signed had nothing about the cancellation policy on it at all but she also sent another paper with it that did have the policy but its on a seperate piece of paper. I have never had anything like this to happen to me before. Before all I ever had to do was tell them I cancel. I am a very nervous person to begin with (Im even on meds for my nerves, Wellbutrin, not the heavy stuff)and I have a hard time dealing with things like this. My husband is telling me not to freak out but every day of my life I go to a job that I bitterly hate and just one week in a year I go on vacation and forget about all this mess and now I just feel like she is ruining that too. I know, Im going to WDW, and that alone should be enough, I know Im lucky to just be going. I just dont like people being unfair about things. Ok I'll shut up now, Im just venting, that alone feels a little better, dont it?
 
Good to hear from you again JANNYANS....Some one was asking about you the other day and i told them to give you a shout! You have allways been a standup owner!!!!!!!!!!There should be more like you! :) I have allway's respected the way you came to help me when i was looking for a place a year or 2 ago! :cheer2: :cheer2: :cheer2:

If the cancellation policy is on a separate sheet that you did NOT sign, seems to me the problem is solved..

Forget the whole mess and have a great vacation!! :flower:

Beautybelle I would write to her and inform her that you have signed nothing that confirms you owe her the rest of the money and that if you have any more communication from her you will refer any further correspondence to your lawyer.She does have plenty of time to try and fill the dates you booked if she wants -she may not do it but there is time .Don't let this incident ruin your vacation in Disney .
