Not sure if someone can help me here but here goes -

We need to change our names on our deeds as we got married last year, my husband changed his name by deed pole before we got married to include his step fathers name and mine obviously changed when I married him.

Member services have told me I need to find a title company or attorney to have the deeds changed, how do I go about this? we live in the UK so I'm guessing we have to find someone in the US?
Is it possible to change our names with member services (we have to just fill in a form and send our wedding licence in) and leave the deeds for now or should we do it asap?

Also anyone have any idea how much this would cost?

Hope someone can help me

Sam

Here are some details about changing deeds, this was posted on the DIS earlier this year and appears to be an email response from member services.

Dear Disney Vacation Club Member:

In response to your inquiry about changing the Disney Vacation Club Membership records, following is information regarding the process to transfer an Ownership Interest in a Disney Vacation Club Resort.

TRANSFER:

A request to add another person to or remove a person from the Disney Vacation Club Membership records is considered a transfer of title to the Ownership Interest. All of the below listed guidelines, including the notice requirement and the requirement that the mortgage loan to Disney Vacation Development, Inc. (“DVD”) be paid in full, apply to the following typical examples of a transfer:

• You and your spouse are on the Membership together and you want to remove yourself or your spouse/ former spouse;
• You are on the Membership by yourself and you want to add your spouse;
• You want to remove yourself and transfer your Ownership Interest to another person;
• You want to add your children that are of legal age;
• You want to add or remove children, relatives, in-laws, or any other living person. (If there has been a death of a Member, please contact Membership Administration.)
• You are directed by a judge under a court order for divorce to remove or add yourself or your former spouse;
• You want to transfer your Ownership Interest into or out of a trust, partnership or corporation.

Written Notice to Disney Vacation Development, Inc.

Right of First Refusal

Before you may transfer your Ownership Interest, you are required to offer it to DVD upon the same terms and conditions, including financing, as those offered to another person or entity. Accordingly, no later than thirty (30) days prior to the proposed closing date of the transfer of your Ownership Interest, you must provide DVD with written notice of your intent to transfer. Written notice should be in the form of a signed letter detailing the full terms and conditions of the transfer signed by all parties. A sample notice is on page 2 of this letter. DVD's right of first refusal shall apply to any and all subsequent transfers or the sale of the Ownership Interest. DVD will either issue a signed Waiver Agreement or notify you that DVD is exercising its Right of First Refusal within the thirty (30) day notice period.

Mortgage Loan

If DVD made a loan to you for a portion of the purchase price of your Ownership Interest, then that loan is secured by a mortgage on your Ownership Interest. A transfer of all or any part of your Ownership Interest prior to repayment of your loan gives DVD the right to declare the unpaid amount of the loan due and payable immediately. Accordingly, you will need to repay your loan prior to or at the same time there is a transfer of all or part of the Ownership Interest. Any information or questions about your loan with DVD should be addressed to Member Accounting at 407-566-3800, Option 1, or by fax 407-566-3284.

Transfer Documents

Your Ownership Interest is an undivided interest in the real property described
in your recorded Deed. The Owner(s) of the real property will need to make their own arrangements at their expense for the appropriate transfer document (DEED) to be prepared, signed, witnessed by two (2) witnesses, and acknowledged before a Notary Public and then recorded in the county where the Disney Vacation Club Resort in which you have an Ownership Interest is located.

You are urged to consult with your attorney, accountant, title insurance company, or other professional advisors concerning this matter. Laws regarding the ownership and transfer of real estate vary widely from state to state. To ensure that the transfer of your Ownership Interest is performed correctly and in accordance with Florida law (or South Carolina law, if your Ownership Interest is in Disney's Hilton Head Island Resort), we strongly suggest that you consult with an experienced real estate lawyer licensed to practice law and in good standing in the State of Florida or if applicable, the State of South Carolina. Both the Florida Bar and South Carolina Bar maintain a lawyer referral service which you can access by calling 1-800-342-8011 (or http://www.flabar.org/) for the Florida Bar lawyer referral service or 1-800-868-2284 (or http://www.scbar.org/) for the South Carolina Bar lawyer referral service.

Written Notice That Transfer is Complete

We will change the Membership records to reflect a new or different owner after receipt and review of the following information:

• The required notice and waives its right of first refusal (Waiver Agreement signed by DVD)
• Full payment on any outstanding Mortgage loan to DVD secured by the Ownership Interest
• Full payment on any outstanding condominium annual dues
• Payment of the $100.00 administrative fee to change the Membership records
• Copy of the recorded deed and recorded waiver of right of first refusal (Waiver Agreement)
• Information regarding the new owner including address and telephone number.

Condominium Assessment/Maintenance Fees/Annual Dues

Annual Dues for the current calendar year must be current or paid in full prior to any transfer or sale. Any information or questions about your dues should be addressed to Member Accounting at 800-******** (407-566-3800), Option 1, or by fax 407-566-3284.

Reservations

A transfer may cause any reservations that utilize Vacation Points associated with your Ownership Interest to be cancelled if a new contract must be created and a new Member number issued. If the transferor is being removed as an Owner/Member, they will not have access as a Member to the Disney Vacation Club reservation system after the transfer of their Ownership Interest. Any information or questions regarding your Vacation Points activity should be addressed to Member Services, 407-566-3800, Option 3, or by fax 407-566-3939, or by e-mail to members@disneyvacationclub.com.

If you have further questions regarding the transfer of your Ownership Interest, please contact Membership Administration, Marylin at 407-566-3352, Margie at 407-566-3041, Kathy at 407-566-3075, Roger at 407-566-3222 or by fax at 407-938-4147 or email at WDW.DVC.DVD.Resales@disney.com.

You may want to contact MS again to see if they can give you a better answer and explain that what you really want is to change your name on their records so that they use the new name in the future. You may also want to consider calling a Flordia real estate attorney. I do not know what impact your being from the UK has on what I generally know to be the likely answer. Usually in the US, if there has been a name change, particularly due to marriage, there is really no reason to try to change the names on the deed until you go to sell the property and then the change is made on the deed of transfer that you sign over to the buyer and the title company verifies that the person selling the property is the same as the one on the deed by noting the name change that appears in public records, e.g., the marriage certificate. However, since you are from the UK and your marriage certificate or other name change was not done in the US, the usual answer might not be the one that applies. As to changing your name with MS so they now communicate with you by your new name and list you under the new name as the owner, that should be done via filling out a form (other than the one shown above which is obviously not for name changes that do not involve any transfer or adding or removal of persons on the ownership interest), and possibly providing a certified copy of the offical document, such as the marriage certificate, that resulted in the name change.

If you're both on the deed already, you likely don't need to do anything. You can change the deed if you want but should really not need to do so. DVC can change how they address you, paperwork and the like without a legal change. They don't like to but they can. No way I'd change the deed if you are all on it already even if your legal name has changed. I go by my middle name and have asked they address me by the name I go by and they have complied. My understanding is they actually went in and changed their computers like we had made the legal change when we didn't. My wife also insists on separate mailings which has been more of an issue over the years.

The process to change the name is the same as that to gift it to someone. This specific method only applies if there is no money changing hands and varies only slightly from that of an outright sale. DVC has a Transfer form you fill out that is signed by all parties exactly as listed on the deed. DVC will give you a ROFR statement assuming all is in order. You'll then need to to be current on any dues, etc and either be paid in full on the loan or obtain written permission from the loan company to change the title. Then get new deeds and have them and the ROFR form recorded at your expense. Send DVC a copy of the new deed.

BTW, I don't recall hearing anyone successful getting the deed changed that had an outstanding loan without paying it off.

Thanks for the help.

To be honest the answers from member services weren't very helpful.

I didn't realise there would be so much involved in changing my name. It seems a bit extreme to go through all of this just because I got married.

It looks like I can do what I originally hoped and just change our names with member services and leave the deeds alone.
So I'm right in thinking the only time our deeds need to be changed are if/when we sell? I guess we would then just have to show proof or our old names, we got married at Disney so our wedding certificate is from the US so I can't see that being a problem.

Thanks everyone

You may want to ask this on the UK forums and see if anyone there has more insight. Best of Luck!

When you sell you just have to sign it the way the deed reads and furnish appropriate documentation that you are that person. It really isn't a big deal selling in this situation. If DVC will change your name in their system, that is definitely your best option. As I noted, they did on ours but it wasn't as much of a change as it sounds like yours is.

Sam,

We've had the same experience. MS hasn't been very helpful at all and although I've asked to be called by my married name they have not yet complied. To make it more annoying, my name is the first name on the deed so all mail addressed to us and all reservation confirmations say "the my maiden name" family when its my husband's name that we go by. Its not that I'm looking to change the deed I just want them to address me and "our family" by a different name.

Well I think the problem may be a bit more than just changing your name since you got married.

You said your husband also changed his name prior to the wedding, so your deeds are in names that neither of you now have, correct?

This plus the fact that you are UK residents/citizens is a bit more complicated.

Personally, I would hire a lawyer and take care of the names changes to the deeds now. This way all your papers will be in order, and you will have no problems should you need to sell or make a will and name your titles to others.

Good luck to you and congratulations on your marriage! :)

To answer your question, it will cost about $200 to change your names, provided you don't still have a loan for your points. You need a closing company to do most of the work to change the names. As for disney, forget all that legal stuff, and just send them a letter stating that you are changing your names, but you are the same people as those on the deed. They send all that stuff about ROFR, but it doesn't apply to you. If they want more, they will send you a note. I didn't get it right, so they just sent me a note that said DO THIS with an arrow toward what they wanted from me. I began with the closing company, and then Disney stepped in and helped me the rest of the way. I just wrote and told them that I must be stupid, but I didn't understand what they wanted, and voila! I got help! Now, the UK might have different rules, so you might want to ask on the UK board, but I found that here in the US there was a lot to do to change names, and it was worth the money to get help.;)

Thanks everyone.
I am going to need to look into this, if it's only going to cost $200 thats OK.

it will cost about $200 to change your names

What did that $200 include? I have to pay Disney $100 I think and that's without what I have to pay a closing company.

Thanks
