Here in St. Louis the Archdiocesean Attorney's office issued notice to all the participating schools that splitting the money with parents by issuing a check or reducing the tuition bill would jepordize the tax-exempt status as a pp stated. As far as I know all of the schools continued their programs and simply made changes.
At our school each family is required to raise $100 from the scrip program as a fund-raiser. You may choose to "buy-out" or pay the difference if you raise less. If you raise more it is just a bonus for the school. The scrip is sold after church on Sundays so people with no children in the school can help with raising money for the school since the church budget subsidizes the school anyway.
The scrip program at our parish is considered to be the "best" version in the area because of the way it is run. They stock about 50% of the available gift cards so you can just walk up after church on Sunday and buy them - no need to order and wait. Any they do not stock are available by Thursday. They also work with local merchants and some of them offer 20%. For school families they can send in an order form in the morning and it will be sent home with the kids in the afternoon. This really helps for people with cash flow issues who cannot afford to pay the money and then wait for the gift card.
