How does Disney know who can stay for EMH?

I mean do they kick everyone out and just let the people onsite stay in? With the MB I know it would be easy to identify but now everyone will be able to purchase one. a bit confused.

They ask to see your resort Key to the world card before you board any rides, now with magicbands they would probably make you scan and it would say where you are staying

Are the MBs scanning properly and correctly? It would suck if an onsite guest is trying to take advantage of EMH only to have MB not scan properly. Anyone experience anything like that?

They can do a manual check as well. Also, if any member of your group as their band scanned, you'll more than likely be waved through. Often the headliners get so backed up, they only scan one band per group anyway

If you stay at the Swan or Dolphin, you will have to show your room card. It won't be RFID compatible, so scanning will be useless. Because your entitlement to EMHs is proven by your room card, make sure that at check-in you get a card for every member of your family. If you think: "Oh, we just need a card for mom and dad. The kids will always be with us so they won't need their own cards", you risk trouble later if you want to use EMH. It is possible that you could convince the CM that the kids are all with you, but you could run into a rule follower.

Many CM's "pretend" to scan the cards from Swan and Dolphin and the Hilton even though they cannot possibly scan. Not sure if they have been instructed to or not. But they actually can't scan anything on those cards.
