I sold an item last week that went for almost $200.00. The buyer was having issues with paypal not accepting bank transfers and she didn't want to pay echeck (takes too long ) and does not use credit cards. After going back and forth her last email to me was "I give up go ahead and relist" I sent her an email saying that it looks like paypal was doing maintenance and I hoped she woul honor her comittment blah blah. This was friday. No word, so I sent a second chance offer and the buyer was thrilled and asked if I could wait until tuesday (tomorrow) so she could send a bank transer. Well, just now I get Payment from Buyer #1 via paypal!!! .

What do I do? Where is my obligation? I sent #1 an email explaining I relisted and am waiting to hear back.

Anyone?

That is a pickle! I think the item probably needs to go to number 2 and the money should go back to number one. Can you get another of the item?

IMO if you have the first buyers email stating that she was no longer interested then i would simply write to her and let her know you sold it already to another party with a nice copy and paste of her email not wanting it. I would also file with ebay to cover yourself, send them the mails from her and proof that you held it for a reasonable amount of time before selling it. Although i wouldnt do any of this until i see buyer #2 sends payment. Then just refund Buyer #1's payment.

Hope it all works out, ive noticed alot of people on ebay lately backing out of deals.
Not sure why but dont feel your in a hold with the first buyer after such a long period of time and after her mail stating she wasnt going to fullfill commitment.

Tink~

Could you tell if Buyer #1's Paypal payment was actually generated before Buyer #1 told you she was giving up and for you to re-list (not easy to determine)?

It is possible something crossed in the mail, in which case you should at least not give negative feedback to Buyer #1.

And you did send a message saying you hoped she [Buyer #1] would honor her commitment after she said she was giving up. From your description this was a technical difficulty, not a refusal to complete the purchase. The time difference Friday to Sunday is too short to assume the other party was non-communicative.

Hard decision to make but I would give Buyer #2 first crack from this point in time onward.
