Have you requested a hardship deferral for jury duty?

Just wondered what qualifies, and if they do some kind of investigation or just throw you back on the list to get called again sometime in the next year. DH got called, I am in the middle of cancer treatments, and one of the particular days they are asking for he is supposed to be out of state for his job, and he's got a very specific function on this out of town date that will affect lots of people if he can't be there. Anyone know?

From previous jury duty posts here I would say it really depends. I would THINK that being required to be out of town for a job would qualify him but it would depend on your area specifically. Honestly I don't think having a family member undergoing treatment would be an automatic dismissal though. In many areas you are "on call" for jury duty, meaning you call in once a week to see if you have to report. You let them know of any travel plans and usually they accommodate you for that. Our old town did it that way. You were "on" for 3 months, calling in once/week. If you actually served on a jury you were done. DH had a few times when he was on jury duty that he had to be out of town for work and it wasn't an issue.

Doubt that him being out of town for work would qualify as a hardship.

In Ct. you can always request an alternative date. Both DSs got jury duty summons while they were in college. Neither one wanted to miss one day, let alone be held over for a lengthy trial during the semesters. They requested dates during the summer and they got them.

Here you have to call nightly for a week. It's really only the Friday that's the issue, unless he were to get sequestered, as I am home during the days anyway when he goes to work. (right now that is; usually I work.)

His CEO is a lawyer so he's going to ask his opinion.

You shouldn't have a problem. I had to request it once as I was the babysitter for my grandchildren while my single mother daughter was in school full time. I was granted the deferral no problem. They sent me another jury duty for summer time. That got canceled. Just write exactly what the issue is and I'm pretty sure you'll be o.k. Good luck.

He can probably reschedule, but how/if you can do that might vary by state...here in CT, when they send you the form informing you of the date you need to go, there is place that you can fill in/check off to change the date of your jury duty, and you can change it to whatever date you want within a year.

He should be able to reschedule. All he needs to to is call the clerk of court or the number on the jury summons.

One time DH received a jury notice. He had major surgery and had been out of work for over a month. The week he was to serve would have been his 2nd week back to work. He called, explained the situation, and they put him off until later in the year (or maybe even the following year).

I got deferred. The week before I was to have served, we got the call to head to Russia to adopt our daughter. I called and was able to defer. They said I would probably be called within the next year. That was 2005 and I haven't been called again yet (knock wood).

it def varies by state. For me, i rescheduled a date back in may and it's tomorrow. I was able to login online w/info they gave me on my card and request new date. within 24 hours, I got an email it was changed, no reason neccessary. Now of course, I really don't want to go tomorrow, as we just buried my grandfather yesterday, but I'll be calling in this afternoon to see if I have to go or not. Hubby said I could get out of it, but really....I'm fine. The thing that stinks is he has to work out of the house w/3 kids as I'm a SAHM. Hopefully if I get picked it's only a day. Last time I was called, I served and it was 2 days.

For our jury duty, we can request a deferral without giving a reason as to why we want it.

when I was stationed in NJ dh got called every year. I'd send them a letter explaining that dh was a construction worker who did not get paid for jury duty and received no vacation pay. They excused him each time. I got called once, also in NJ, and when they found out I was a cop on active duty they wanted no part of me lol. That was in 1985 and I haven't been called back in any state we've lived in.
