I took a bag in today for someone (small private owned business) to monogram a mickey head on it and they said they couldn't do it because of copyright infringement and we got to talking about designs on t-shirts and they said that they have heard that people have been pulled aside and asked where they got their shirts and had them taken. I have many awesome personalized designs that some of you have done for me and I'm kind of scared to wear them now. Do you think I should be worried? I don't want to lose time in the parks because they want me to go back to the hotel and change.

I have never heard this so I am praying it doesn't or won't happen..I have shirts for each day:)

I wouldn't think that it would be a problem as long as you don't sell your t shirts. if they look "homemade" and not store bought or you tell them that you bought them from someone else besides Disney or a partner, I wouldn't think it would be a problem. Just my input, I could be wrong. Anyone else?

They were telling me that you are allowed to create one design for yourself. I asked about same designs for the rest of the family and they understood it to be 1 design for yourself only. I'm confused.

We were in WDW in February. 3 children and 5 adults wore matching tshirts everyday. all we got were compliments? :confused3

well then, we had a family project and 21 of us each made our own shirts... including the 5 year old! :cool1: (it's either that or I'm not gonna be able to walk b'c of wearing 21 shirts on my body! :rotfl2: ) I'm sure we're gonna stick out like a sore thumb. DH is very concerned; I'm anxious but... after all the work by everyone involved - I'm wearing 'em! we'll see how it goes!

Just my thoughts but there is Disney software that is sold that allows you do multiple things like make invitations, tshirts etc. They also sell cartridges for sewing machines, scrapbooking etc, which could create the autograph books, tote bags etc. I doubt any one person knows what every single piece of mass produced, distrubuted disney product is. Along with that how many of us bought a PC or printer and got some free software that allows you to create tshirt designs or cards. I think the issue comes down to is if someone is selling designs and not paying disney royalties then there might be an problem. Since the wonderful creations created her on DIS are for individual personal use, I would not worry. If anyone asks I would just say the truth, you made the items with a little help from some creative friends.

Now I have read some threads where some designers have been asked to stop designing but again that might be a copyright issue. So they do watch but my guess is their concern is how the clipart is being used in what context if it is being used for business purposes etc.. With the Internet I would guess their major concern is loss of royalties and Disney clipart not being used in an approriate manner that would harm the Disney name.

Sorry for the rambling that is just a perspective of someone who used to work for the logo police

"Fair Use" dictates that copyrighted material may be used for "personal" use only. Pretty much, anyone who uses copyrighted material for their own use (could mean family) and are not trying to make money on the material, and certainly are not taking money from the copyrighter, falls under Fair Use.

No one from Disney has any right interrogate you about what you are wearing, nor do they have any right to confiscate it. (Unless, of course, it violates their dress code. But still they couldn't take it, just require that you not wear it in the parks.) It would be up to a court of law to determine whether you violated copyright law. That is a complicated area of law that even trained attorneys in other practices do not always understand. Let alone a lay person working at a Disney park, however great customer service peopel they may be. Beyond that, I cannot imagine that they would risk good will by doing that at the parks.

Hope this clears up any confusion about copyright.

I agree but just in case, I've already planned to say that whatever item it might happen to be was a gift, so I don't have any information on where it was purchased, yadayada.

What are you supposed to do if you don't bring any other shirts and they ask you to take it off? I guess we'd have to spend a lot of money in their stores??? This is crazy!!! Just my opinion!!

When you say one design, do you mean you are allowed only one design, or do you mean you can't make more than one shirt with the same design???
TIA

They won't ask you to take it off. Really, I've been to WDW in these shirts for 15 years and I've never been told anything. This person may have met up with a CM having a bad day. As someone previously posted, there's no way that anyone, including the top brass at WDW, would know of every Disney design available.

we were there in March and the CM's loved our shirts!! They would greet us by name when we wore our family shirts, and then commented on the others. I was constantly stopped by people asking where we got our shirts, and one of the Photo Pass Photographers took quite a few photos of us 'cause he loved our shirts!!! We had nothing but good times wearing them. :goodvibes

There was a t-shirt design that had all the World Showcase countries and blank spots to "write" in what alcohol you drank and where (saw this somewhere on the boards) I could see how they would not allow something like this since it possibly promotes drinking/drunk people in the parks.

I don't see how CMs could police what is "home made" and what is bought from the Disney approved sites. Many of the designs on here look better than what the Disney store sells. How could they possibly know?

Disney has bigger fish to fry than to worry about what a few hundred DISers wear to their parks. All I've ever gotten from Disney CMs is "You made that, how cool! Hey Marty...come and look at this. She made it herself!"

ONE designer was asked by Disney to stop making designs by Disney. She had her own website.

Disney provides desktops/wallpapers on their own sites for download. As someone else posted Disney sells software to make different things, cards, etc. I think nobody here has anything at all to worry about.

If anyone asked me to remove my tshirt I would call the police.

Kari

but..I'm not a lawyer...I only play one on the disboards.:rotfl:

YOU GO GIRL:cheer2:

THAT IS MY EXACT THOUGHT..DISNEY HAS WAY TOO MUCH TO THINK ABOUT RIGHT NOW,BESIDES YOUR DESIGNS . EVERYONE IS DOING IT FOR FUN,NOT PROFIT.
I THINK ANOTHER LAWSUIT WOULD ARISE IF THEY ASK ME TO REMOVE MY SHIRT (LET ALONE A STAMPEDE OF PEOPLE RUNNING THE OTHER WAY!:rotfl2: )

I kind of find it funny that people are so "scared" about wearing these shirts. There is NO WAY that Disney could prove that you did or did not buy a shirt that was or was not designed by their corporation. This fear is completely unfounded. The only way anything could be copyright infringement is if an unauthorized designer was receiving money for their designs without Disney's knowledge and consent. That would be the thing to be afraid of. The great thing about this board is that these people are taking time out of their busy schedules to help us create memories. I do feel bad that some have to stop because people were offering donations. However, that is the only reason that they cannot share their designs anymore. Now if Disney were smart, they would hire these designers here. I think their designs are better than those in the stores!

So go to the parks, wear the designs, and be PROUD to be a part of the DIS board community!
