As long as they haven't punched a time clock,they aren't working, so Big D shouldn't be spying on them.
But Disney has the right to set policies for their property, being on or off the clock doesn't necessarily have to have anything to do with it. If a Disney employee has a wreck on Disney property on or off the clock, Disney can look out for a law suit.
I would certainly imagine that if it came from Disney's law department, they would have the good sence to know whether they can or cannot do this. And besides, its a good thing.
It would be nice if people used common sense and didn't text while driving, but it just ain't gonna happen.
