As long as they haven't punched a time clock,they aren't working, so Big D shouldn't be spying on them.

But Disney has the right to set policies for their property, being on or off the clock doesn't necessarily have to have anything to do with it. If a Disney employee has a wreck on Disney property on or off the clock, Disney can look out for a law suit.

I would certainly imagine that if it came from Disney's law department, they would have the good sence to know whether they can or cannot do this. And besides, its a good thing.

It would be nice if people used common sense and didn't text while driving, but it just ain't gonna happen.

Before I write this please note I don't agree with texting and driving. I honestly think that is why I was almost hit on my way home from work today.

However, Disney has absolutely no way to police off the clock CMs who are driving on property. They can't have Orange County pull them over if they see it for two reasons: 1. It is legal in FL to text and drive, 2. They have no way of knowing if it is a CM or a guest.

I'm not saying people should do it, but Disney really has no way to control if people do it on their own time on property or not. In reality it is hard to control even on the clock. If you are driving around property in your vehicle on company business they really have no way of telling if you're texting or not.

Now for people like transportation CMs it is a little easier to control because the guests will ultimately turn them in. During training DH was told stories about bus drivers being fired after videos of them using their phones while driving the bus popped up on YouTube.
