Getting sued at Christmas..

Well to make a long story short I had a bill at the hospital no insurance and I guess I just figured they would write it off. Not so I got a summons to be in court Jan 21. I called and asked them to verify the charges as I didn't sign anything when I was there and of course they said fax us a copy of your drivers license to verify signature.. Uh No way but any advice would be great they are charging me aprox $5000.00 for a visit to bandage a finger (no stitches $500 aprox) and the other is for a kidney stone they pumped me full of meds did some x-rays and sent me on my way $4500.00 for that one yes I know I should have health insurance but I have not had steady employment for 3 years, and I have some money coming in at the end of January if I can get them to settle for a lower amount. Any help would be great. Please don't blast me I already feel bad enough No I am not going to file bankruptcy on $5k I do not want a judgement on my credit report although it would be paid off in a few short months if they don't settle with me first.

I am in no way experienced with this, but I thought that if you make payments every month (even just $5) they can't do anything to you.
 
They would not verify the overages on the bill there is no way it cost that much in my opinion. But yes I have been told that even if you pay a small amount each month.
 
They can still send you to collections even if you pay something each month. Does your hospital have a program for low income patients? You could check into that, if you qualify they may lower or even waive the charges all together. I have a lot of experience with medical bills, we average $700-1000 a month. The best thing to do is call right away after you receive the bill and set up a formal payment plan. If you have a payment plan and you stick with it they can not send you to collection. Did the sue before even trying a collection agency?
 

we sent in a hardship form and never heard anything from that? I wonder if the summons and the hardship form crossed in the mail.

actually it could cost that much depending on everything you had done both visits. Where I work we offer self pay patients half off.

Have you ever made any sort of payment to them for services you recieved? and gee, you asked them to VERIFY when you know you had been there?

I think the only thing you can do is offer to enter a payment arrangement? Is this a for profit hospital?

They way over charge, I had a one night stay and left AM, they double billed all my meds, and then told my insurance I was on observation, for my copay, but charged two days for the room admission...

The hospitals have a seperate billing for no insurance, and they have funds too. That is why the waiting rooms are so filled with many people that do not have a doctor.
keep calling and get it down to affordable doable amount and make payments. There is a patient advocate I have been working with on my bill.

Not sure where you live but NJ had passed legislation that self pay patients are only charged 115% of the Medicare rates. Some providers are having problems automating the process but most will do it if you call upon receipt of the bill.

Also check out state charity care and programs. Some hospitals have internal financial assistance programs. The bill was nicknamed the Reinhardt Commission report for the group that initiated it.

And... hospitals do not charge off bad debts, non profit or for profit they have to bill for the services they provide. It places a healthcare facility in a bad spot when ER's are used as PCP's for persons with no insurance or who are underinsured. Reimbursed for those are nil and the reimbursement is contigent on people being approved, bills being submitted to the programs involved, etc. etc... It is very costly for hospitals to follow up.

But, call them - chances are they will work with you if it means settling and no litigation. Make an offer based on a percentage, but make it a realistic percentage.

Just my 2 cents, sorry to hear about the issue. Keep your head up and just work with them and they will work with you.

on an aside "lower the amount", I would have no problem paying my cc bills if they lowered the amount. Think of the overhead a hospital has, how many people attended to you, what supplies were used, salaries for the doctors, etc.....you may think a bandaged finger should cost you $50, it cost the hospital a heck of a lot more ESPECIALLY if you went to the ER.

although being sued you may be off the ship, but YOU need to go down to the Patient Financial Services office and ask for that. They are charging you FULL PRICE right now, did you offer to work out anything in the beginning? But, did you go knowing you couldn't pay? Did they offer you any assistance as far as qualifying for help??? Also, I asked before, is this a community hospital or a for profit? THAT can make a huge difference.
 
I had a trip to the Er for a kidney stone...cost $7598. So yes it can cost that much. Thankfully I have insurance and only had to pay $100. Never ignore a hospital bill hoping they will write it off! Always call and make payment arrangements and they are almost always willing to work with you.
 
It is a profit Hospital I think. They only offered the hardship form a few weeks ago we filled it out and got the summons instead of help. I didn't offer anything because anytime I talked to them which was once or twice I said I needed an Itemized statement still have yet to see that. I also asked to see my signature from when I was there and they can't provide that either. I was told I would have to go to the hospital and get a copy the other day when I called and they said the only way they would work out payment arangements was after a judgement had been entered. My thing is what am I being charged for and sued for they won't send me the info as I requested. I feel like not only am I being bentover the barrel on the bill now they are sueing me without even sending me an itemized bill.
 
This has to be an OLD bill. They just don't work that fast to take you to court.

Get what they've sent you together so you have your account info right there.

Go into or call their Records Department. Find out what you need to do to get your records. See what people saw you, what was done, etc. You will probably need to bring in a signed permission form. Since you don't have a job right now, you could probably just go on into the hospital tomorrow and take some time to do this in person. But you want to get your records.

They do have the right to charge for copying, so if they aren't going to give you *anything* without money, ask that they sit with you and let you review the records. The hospital where this was relevant for me gave a 15 minute appointment for this. But they did just send me records...not the printouts of various machines, but basic records.


Go into or call their Billing Department (if that's on site you might be able to go in). Request an itemized bill of your visits. You want to see what they billed. Did they bill for 3 $15 Tylenols or 11? Did you even have any Tylenol while there? etc etc. Make sure you were there the days they billed, etc.


Once you have both in hand, compare them. Your questions should be answered.

Don't get tweaky about how much they charge. It's WELL known that hospitals charge a TON for simple things, like Tylenol. And you aren't supposed to take your own, because they know that if you take something and something goes wrong with you, you would never EVER say "oh yes I took something". You would blame them, you would sue them. So they control what you are given, even though it's going to cost the earth.

Then you need to see IF they will start working with you. I'm sure it was long ago sent to collections, and in that case you MIGHT be able to get them to pull it back from collections, if you can promise you're going to start working with them. I was able to pull something from collections while I researched things...there was a practicioner name on my paperwork that I didn't understand. Took AGES to figure out that it was a person that worked with the doctor on call. While I researched, they took the debt back.

And then I never followed up, and it was sent back to collections. :headache:

Collections people are a PITA (pain in the...). They are mean, rude, and rotten. They will swear that they won't take your partial payment. But you send it and they will cash that check. Don't let them get to you. They are underpaid people in a cubicle miles away from you; don't give them your day.

Once, my sister in law wanted to help me. She wanted to pay (love her for so many reasons!). She's a lawyer. She called and had NO problems. They didn't get twitchy with her as she used her Lawyer Voice. Well it turned out that they were not all that bright (this is Merchants Credit in western WA, for the record), and while they had someone right there ON THE PHONE, willing to pay it all...they didn't give her all the charges. :headache: So a year later suddenly we were being billed by them again.

But after that, I liked to pretend that I was my own lawyer, and I pretended like I was billing a client for this, and they weren't going to ruffle my feathers. When we finally decided to get the monkey off our backs and called to pay, as I was actively paying them, the lady tried to start an argument. NO. I acted like I was my lawyer (I didn't TELL her I was someone else, this was a mind game I played with myself), told myself that this wasn't personal, and I just shut her down.

It's HARD to stay unemotional. But do it anyway. They aren't worth the heartache, especially when you are actually working to pay them what you owe.

And remember that...no matter how bad the care (and I had some awful care), no matter how high the markups, you went there, you got the "care" or care, you do owe them the money.

So get your records, get the itemized bill, and start moving forward. Even though the "care" I got nearly killed me, and scarred my son b/c of their lack of medical knowlege and ability, even though I didn't *want* to go there to begin with, I did go, I owed them. And it felt SO GOOD to make that final payment nearly 5 years later...
 
I'm sorry this all happened, but you seem to have a sense of entitlement....they should lower the cost for you, they should have written it off, they should show you the proof of costs...and I think that instead of ignoring the bills, maybe you should have "met them halfway" and at least communicated with them before it got to this point.

But now that its a little late for that, I think I would get my butt up there in person and sit down with someone face to face. They just want (some) money, and its costing them money to hound you for the money and sue you, so maybe they would be willing to work something out before it gets worse for you.

Yes, hospitals charge a lot. I work at one - I know! But the services were rendered and now you owe the money, like it or not. Apparently, they plan on getting their money, so the best deal for you is to try to get them to take as little as possible, make payment arrangements you can handle, and save your credit. I'd call and make an appt to talk to someone ASAP!
 
Yes Molly it is an old bill they just don't want to work with me and I do plan to go to the hospital this week and pick up copies of the bills since they won't send them to me. I have access to the funds to pay this off if they take a partial settlement just not by the court date. seven days later. Like I said earlier the hospital is not very cooperative. The other hospital that we use for my childrens births etc is great they will send us anything no problem no questions.... I just wish I knew what the heck happened with the hardship forms we sent in. Did they get lost? Did they not approve us? I have no idea...

how long ago were both visits? The judgement was not entered in without them trying to make contact with you for some kind of payment arrangements well prior to the hospital sending it to the courthouse, as hard as it may be to hear, you dropped the ball. You do not need to see where you signed unless you are saying THEY, the hospital or doctors, who provided you a SERVICE, which you have recieved and are living from, are LYING. You can request, but step it up, march yourself down there....you could get there when you were hurt, get there now.

as posted prior, I am SURE they contacted you prior to them filing papers, so it is you who was not willing to work with them at the time. and hey, I can understand, I have dug my head in the sand many a time, but you recieved care, you KNOW you have recieved it and then you are asking the place who provided you care to provide PROOF - in a way to avoid teh payment of the claim??
 
This might be what you don't want to hear right now but we were sued for a medical bill from a car accident. We stupidly released the car insurance a month after the accident thinking things were fine and then my DH(who didn't have medical insurance) had to have emergency surgery to save his leg from an infection. We tried to work with the hospital and collections agency but they were unwilling to work with us until it went to court. We did not get a reduction in the amount due but we did get a comfortable payment amount in the terms of $200 a month. The bills were over $100,000 which the hospital wanted in one shot...:scared1:. We will be paying for a long time but it is workable for us now.
 
I can pay this bill if they lower it to a reasonable amount 50% like $2500 but not by June 21 I am going to call the hospital tomorrow after reviewing the bill and offer them that if they will stop all legal proceedings. I am sorry I put this on here didn't mean to get everybody all worked up.

I know I should have taken care of this earlier but I was not working and did not want to over commit myself or make promises I couldn't keep.
