FYI on your "record"

Another post got me to thinking that I should post this but thin it got locked so......

When someone does a back ground check on you, if you have been arrested it shows up, yes even if it was when you were a juvinial. Even if charges were droped, even if it went to court and you were found NOT guilty, even if you payed a lawyer a lot of money to have the court record sealed. Yes the court record is sealed, but not the arrest record it will show up.

My state does a back ground check on all Firefighter students, many student check the box no arrest record thinking the file was sealed but the arrest shows up causing all kind of problems because now they lied on the application

I'm not saying this is right just the way it is. If you are giving a finger print check for any job like the school system or something that a state andFBI check is going to be done you better be honest
 
I always assumed that honesty was a given.

If they ask if you have EVER been arrested...even if charges were dropped, the answer is yes.
ETA: But if they ask if you have EVER been convicted and you weren't, then you can no.
 
yes you must read the question carfully.

the post I refered to there child was arrested and they seemed to think it was not big deal. They would probly just pay a fine and have com. service. but to me having a arrest record is a big thing.
 
Never arrested (I was taken home by the police once for driving my Jeep through a public park and getting it stuck - but not arrested).
 
You can have charges pressed but not be arrested; that won't show on your record.

I believe you are mistaken. I don't know of any state where juvenile arrest records are ever public record. Now the court records, IF you are a minor and tried as an adult, would be public record.
 
Never had an employer question it, but when my son's Little League did a criminal background check on me (as they do with all volunteers) the guy reviewing the reports did ask why I had a FBI fingerprint number. I had applied to the local Sheriff's academy, and the first step was being fingerprinted and having the FBI do a background check on you.
 
I perform background checks as a part of my job. If you have your court record sealed/expunged, the court clerk's office is responsible for notifying any agency involved, that might have record of the charge, and they are suppose to seal it! There are exceptions as to who can be privy to sealed information though. People that work with children, the elderly, police, fire, someone wanting to join the military, etc, where the public safety might be jeopardized are examples.

I agree, be honest from the start and then nothing will come back to bite you!

I am not mistaken. Not if your in Fla. and the back ground/fbi check is being done by the state to see you you can get into firefighter school. That is the only reason I know this students all the time say NO arrest record the next thing you know the state is having to talk to thim.

Like I said, not every state is the same.. But a bit different from a California perspective where we have firefighter training programs in the state prisons, and where we use prisoners on the fire lines to fight wildfires.

any public safety agency,the millitary, and any school system can in ANY state. "Sealed" does not mean it goes away, just that the general public doesn't have access to it.

Interesting. Will have to put in a few calls tomorrow and clarify. Only instance I can think of that I thought was an exception is if a 17 year old gets arrested for DUI. That's because it is an automatic 1 years license suspension, and that would carry through into adulthood.

The difference is a law enforcement record and a public record. The public record only includes convictions. Schools are not entitled to everything, only convictions.

The law enforcement record includes everything.

So WalMart will only see your convictions, applying for employment with a law enforcement agency will give them everything.
