Federal Judge Overturns Mask Mandate for Flights and other Transportation

Where did you see that? Last I knew they were wanting it to continue. It's just the a-holes who cause issues they want to have more severe consequences.
It's in the article: "Airlines have repeatedly asked the Biden administration to the drop mask mandate as well as other restrictions such as predeparture testing for all international arrivals, including citizens."

It's an interesting legal question of, considering how cases are going and the close expiration of their 15-day extension, whether the government would invest resources in an appeal to argue and brief this issue that could easily become moot in the intervening time. If this was a private client looking at something that would expire in a couple weeks, I might tell them not to waste time paying me to pursue an appeal. But, the government's attorneys don't bill their client hourly, so that kind of cost/benefit analysis isn't applicable or persuasive. Or at least it hasn't been in my interactions with the federal government and its counsel.

I'd maybe prioritize my resources on a clarification of the mandate that might address this judge's opinion (whether there is any strong legal basis to it or not) as to improve for the future.

My understanding is the CEOs want it gone, but some of the flight attendant unions definitely do NOT.

That I can definitely understand. The CEOs are in their nice, isolated offices. The flight attendants are constantly in the planes in the air with everyone flying.

Would be neither the first nor last time the suits wanted something contrary to the desires of labor.

The major union is asking people not to spend the next 48 hours being jerks: https://news.yahoo.com/flight-attendant-union-asks-patience-210711145.html

The Southwest attendants asked for it to be dropped, as did a couple others. I think Delta? attendants were still in favor, and possibly another of the majors.

Not being from the US I'm just wondering how it is all going over there at the moment.
I find it strange that here in Australia we had some of the tightest rules for a long time, including completely closing our International and internal borders for a long period of time. But we seem to be coming out of it faster than everyone else.

We no longer require a test at all to enter the country (you do need to be vaccinated to enter), cruises are back from today with no restrictions, masks are totally optional everywhere (except for one state who are a bit behind the rest of us) Masks for kids were always optional (under 12 years old)

My family are coming to the US in November for a cruise from San Diego and a visit back to Disneyland. I hope the testing is gone by then, adds so much stress and as an Adult I don't mind wearing a mask but I don't want my kids to have to - especially since they weren't used to it here when they never had to wear them even in during the peak of the pandemic.

In the cruising subforum, I think much of what is done is less dependent on conditions in the United States as opposed to conditions and laws of the places a boat is going to visit. And that a boat, if it wishes to dock there, has to be in compliance with those laws. And that those countries and territories have not had the same near-ubiquitous access to vaccines and treatments that this country and other more affulent nations have been able to enjoy. As a result, what might make sense for me to travel across the town, the state, or even the country is not the same analysis that my appearance in another nation might entail due to those differences.

I absolutely 125% think that conditions and availability of treatments in the United States as we sit here and type today merit a very different response than 4 months ago, 12 months ago, and further back. I am not so confident that rule applies in Tortola, or the Bahamas, etc etc and I'm certainly not informed enough to speak of them. But I sure wish and hope their conditions and availability of treatments are the same as ours so they can have the same realities we currently have.

Testing was mentioned in the article, but as a request by airlines. I’d guess that if it’s removed for flying, it would include port testing.
The testing is for entry back into the states. I believe the port testing is so that the boat can go to the Bahamas etc . So what the USA does will have no change on port testing.

Since the ports (or airlines, or any business) can still require masks, and no official change has been announced regarding DCL's ports, all we can do is speculate how this development will affect DCL. Given that we have no solid information right now I am going to close this thread.

If DCL is to make an official announcement with any changes to their policy feel free to start a new thread.
