EBay sellers how to handle requested refund

I sold my old Iphone 4 on EBay for $200, they have opened a complaint saying the item was not as described and that the battery runs out quick and charges slow. All not true and I've literally never had a compaint about what I've sold. They want a refund and have gone through the resolution center to try and get one.

I have no intention of giving them a refund since they got exactally what I listed and they got a pretty good deal on it too. (And I went through the hassle to ship it and [paid for Fedex shipping accross the country plus if I do get it back how do I know it hasn't been messed with or even switched with another phone) Anyway I transferred the money out of Paypal almost as soon as it went in. The resolution center e-mail says they will put a hold on my Paypal funds until this is resolved which is fine with me because there are no Paypal funds. Does anyone have experience with this? Any advice for me? I only sell occasionally on E-Bay and to be honest I don't care if I get one horrible rating from this person since I have so many good ones or even if I have to abandon the account all together. Also wondering if they can touch the money I have in the checking account that is linked to my Paypal account.
 
One response, of course, is that it is a used piece of electronics and one would not expect the battery to be in perfect new condition as far as charging time and length holding a charge. And thy should not have expected it with a brand-new battery unless you had advertised it as such.

I have an iPhone 4 that has been problematic and what they're describing is contradictory. If an iPhone is running down its battery very quickly, it also charges very quickly because the battery is simply not holding a very large charge anymore. If it charges slowly, that is on the charger they're using, not you. But a phone which has battery that drains too fast is also not going to take long to charge. Sounds a little bit like buyer's remorse to me, but that's not going to make eBay or PayPal force them to keep the phone.

I have no intention of giving them a refund since they got exactally what I listed and they got a pretty good deal on it too.
I have been a long time buyer and seller on eBay, and this sort of attitude is not helpful in creating an honest selling environment. If you stated your return policy on your listing as All Sales Final, No Returns, then you can stand your ground. However, if your return policy was not stated, then you need to be a bit more understanding. That said, did they buyer contact you before purchasing to discuss return policy? If not, that's also on them, too. But again, eBay/PayPal, will not back you up if you do not have a return policy stated clearly in your listing.

Even if you allowed them to return it, you would not refund them the shipping charges you've already paid out of pocket. And they would have to pay to ship it back to you with some form of tracking so that they can PROVE you received it. It is quite a hassle on their part, too.

If the buyer escalates this to their credit card company, PayPal can go into your accounts and remove the funds, but my experience was from back around 2006: A person purchased $1400 worth of new designer clothing, paid, received and then claimed she never made the purchase. The same person then turned around and *SOLD THOSE VERY SAME ITEMS* on eBay under her SAME eBAY ID (!!!) and even then, eBay and PayPal did nothing but remove the money from my account because the credit card company did a chargeback. We had the local authorities in Australia involved, yada yada. So in the end, if you have a strong case, eBay and PayPal are not on your side.

Not saying that this is still how it works with eBay/PayPal, but you should be prepared to be flexible about the return and put the onus on the buyer to prove that the phone is "not as described". Did you say it was in perfect condition? If all your listing said was that is was used, then they should expect a little battery decline.

Why not do this:
Require them to take it to AT&T or Verizon store (whoever this phone's system carrier is) to have a store manager VERIFY IN WRITING that the battery is defective and then fax that letter to you. Then once they've provided that proof, they need to ship phone back with tracking.
And only once you've received your original phone in same condition as it was shipped, then will you offer to refund purchase price minus your cost of shipping to them.

Make sure to take photos of whatever they send back, so that if they try to pull a fast one, you can show what came in the box versus the photos of your phone shown in the listing.

Hope that helps. I don't want to sound critical of you because I am on your side in this particular case, but while I want you to be prepared to do what's necessary to protect yourself from a possible scammer, I'd like you to consider also being open to the fact that the buyer may not be lying or knowledgable about iPhones. Asking them to go to a local B&M store to have the phone looked at might teach them a thing or two about the great deal they just got on their phone.

I also don't want to come off as condoning the "I don't care about one bad review" or "I don't care if I have to abandon this account" approach. We're all here because we love the magical experience that Disney tries to provide, and why not try to provide a good level of customer service, too. You don't need to be a push over or get taken advantage of, but to immediately respond by refusing to be helpful sounds a bit defensive, IMHO.
 
What was your refund policy? Did your description mention battery life or specify "as is"? Did they email you or just go through the resolution center? How old is the phone? My DD's 4s used to be mine and it's 2-years old and loses a charge VERY quickly. I am going to bring it into a local cell phone repair store and have them replace the battery. It's going to cost me about $35-$40 but I don't have to hear her whine about the battery life so it's worth it.

Personally, I would refund their money because they could easily get their money back from PayPal *and* keep the phone. I would ask them to send the phone back and after checking to make sure it was the correct phone (http://support.apple.com/kb/ht4061) I would refund their money. Then, I would replace the battery (if you're handy there are videos that will show you how to do it for less than $40) and I would relist it at a higher price and mention the new battery.
 

My settings are for no returns but with the "new" money back guarantee that Ebay offers if they claim that they did not get what the description stated then Ebay will make me take the return back, even though I state no returns. It was free shipping so I paid the shipping out of the $200 and I didn't cheap out on the shipping either I sent it from Connecticut to California via Fedex. I was using the phone up until 2 weeks before I sent it out and it was totally fine. I said it came with the original box, headphones, charging wire and charging block which he claims is not true. He also says the numbers on the box don't match the numbers on the phone which is possible because I could have put it in my husband's phone box since he had the same phone (I don't have the other one anymore). All the other stuff really is all original apple accesories. I say I have no intention of giving them a refund however it seems possible EBay could force my hand on this. I would never sell someone a crappy product. I'm confident I sold them what I advertised to them and that they got a good deal. I don't know where the buyers remorse is coming from , sounds like they were expecting a phone that was going to behave like a brand new phone when in fact is is clearly listed as used with scratches on the glass even! It's just such a pain in the neck.

It does sound like he's getting his ducks in a row to cheat you. However, there is NOTHING you can do about it. NOTHING. If you refuse to work with him eBay and Paypal will take the money back from you and you will be without a phone and without $200.

As for shipping, next time send the phone USPS Priority Mail in a small flat rate box with insurance and signature required. It will cost you a lot less than FexEx.

Wow. That seems really unfair. What has eBay said to you about this? Because now it is their word against yours.

If you take the return, I would still tell buyer that you will deduct your spent postage cost (email receipt or scan of receipt) from refund since that is money out of your pocket. I don't know if eBay allows it, but it only seems fair.

What was this buyer expecting?!?!? You sent not just the phone but all the accessories, too. He could get $200 back just from selling those, LOL.

How have your conversations with eBay gone regarding this sale? Did you ask them if htey make exceptions on return issues for things like electronics and how you're afraid that if they buyer sends something back, it may not be in the same condition as how it was shipped out?

I have to do a little more research on eBay, but I want to say I'm sorry you have to go through this. :(

How is this buyer trying to claim that the item does not match listing description?
That the box you sent it in is not the same as the phone's info?
And that the battery dies quickly?

I'd talk to eBay and express concerns about being scammed since you said you used the phone up to 2 weeks before selling and it was working fine. You don't want the buyer to buy your phone, switch out the battery, and return your phone to you with a bad battery and get a refund for all that. See what they (eBay) suggests.

Exactly what I'm afraid of. I am only in the very first stages of this complaint, so far we are still in the buyer/seller try to work it out ourselves phase. I really have no intention of budging. I really feel like I was super fair. I guess if he wanted like $10 back because I gave him a different box I might do that, thats about it!
 
Did you keep track of the serial number of the phone? Buyer might be trying to pull a bait and switch...keep your phone and send back a different phone and/or battery.

In my experience, Ebay/Paypal always sides with the buyer. :mad:

I don't know if maybe itunes saves serial number info but I didn't specifically record it.
 
I also just sold a phone on ebay. It was a brand new Samsung note2 that still had the wrap on it! I got it for my husband and he wound up getting the same one from work. I couldn't take it back without a restocking fee so thought I'd try ebay. I had never sold before. Everything went great until I had forgotten to send the little cardboard sleeve that goes around the phone box. This buyer asked for it so I sent it. He still wasn't happy and opened a case against me. Ebay found in his favor. So he sent the phone back, without that dumb sleeve. Well if that thing is so important I want it back before I refund! So I have opened a case against him. This is so dumb. For my first sell this is an awful experience and I don't know if I'll have the guts to do it again.
 
eBay's Buyer Protection Program has been in place for years. If a buyer claims an item is not as described, then they will make you take it back. You have to argue that it is, in fact, exactly as you described in the listing. eBay rarely sides with the seller.

Paypal will refund the entire payment to the buyer, including shipping. The buyer will be responsible for shipping it back to you with proof of delivery. The sad part is that it is going to happen. It's easiest to just go along, get the phone back, and list it again.

Alternatively, if you work with the buyer, perhaps they can take it to an Apple store and get the battery replaced, or the phone swapped out, for a smaller charge. You can offer to pay that charge or split it with the buyer. You might make less on the sale, but you'll both come out better in the end.

Oh that stinks! USually my transactions go wonderfully. I don't usually sell such expensive things though. Dont know that I'll sell electronics ever again!

This sounds like a really good idea, offering to split cost of new, replacement battery. It'll cost almost the same to buyer as if he/she sent it back to you, and although you'll be out an extra $20, you won't have to go through the nerve-wracking process of relisting and hoping for an honest and satisfied buyer the second time.
 
And this why I don't sell electronics on eBay. Too many scammers. Some if them especially look for small time sellers since they are pretty sure they don't record serial numbers. In fact even though I sell a lot on eBay when it came time to sell my old iPhone I sold it to one if the cell phone buying stores rather than eBay.

In the case at hand, eBay will most likely side with the buyer. Calling may help if you luck out and get someone in the US (most of their CS is outsourced though). Did you record your original serial number? Hope you did since eBay will probably require the buyer to send it back to you and if you don't have the serial number you won't know if they shipped your phone back.

The Apple store does not replace batteries for the 4. The buyer will have to take it to a local cell phone repair store and the price will be between $35 and $50 for a new battery. That being said, using Yelp to find a couple of companies in the buyer's area and offering to split the cost may be enough to make them happy.

He shipped back the phone and they destroyed it! Prying the back off!
Front cracked everything! Bad news!
