Ebay problems

I just recently started purchasing some things on eBay. Most of the items have been as described but I'm having trouble with two.

I purchased a Stitch costume pajama and contacted the seller before bidding as they had two different photos of similar Stitch costume pajamas. I was told it had teeth like the first photo. When it arrived it looked not at all like either photo. It has really short legs on it and it hangs very low in between the legs. Now I know my niece won't care since she didn't see what I though I was buying, but I'm annoyed. Shipping back to China is not going to be worth it, is there anything I can do? I don't want someone else to purchase the item I got thinking they were getting pajamas with legs.

I also purchased a Mickey and Minnie cookie stamp set and it arrived with a portion of the mickey head missing plastic (molded improperly). The buyer said they will ship a new one to me after I leave positive feedback. Once I do that they could not bother re-shipping, correct? What should I do on this one?
 
You can open up "not as described" cases on both sellers if you want. This can be done either through Ebay or through Paypal. You have done your part in contacting the sellers. As far as leaving positive feedback in order to get the item corrected, that is ridiculous! They get the positive feedback after they have corrected the problem!!! I have been an Ebay seller for years and what you are describing with the cookie cutter is nothing short of feedback ransom! I would report that to Ebay most definitely! Never leave feedback before the problem is corrected! This could hurt your chances in getting it resolved properly! **Sellers are not supposed to do that sort of thing**
 
Open up not as described cases. Sometimes ebay will give you a courtesy refund out of their own pocket, but don't count on it. They may require you to return the items with tracking for a refund.
For this reason I tell people don't buy anything from China (even though it's cheap) unless they are willing to lose the money if if doesn't come as described.

As for the seller asking you to leave feedback first, they may be baiting you to mention 'feedback' in a message to them. Don't EVER mention feedback in an ebay message with a seller. If you later leave them a negative they can get it removed because they will claim you were threatening their feedback.
 
If I open a case for the Stitch costume and eBay/Paypal say to return it, do I have to or can I keep it and just pay? I don't want to have to send it back as I know it will cost a good deal of money and I'd rather my niece enjoy it since she doesn't know what it was suppose to look like.
 

If they tell you to return and you don't that is fine. I do think they are keeping track of buyers who open cases and then don't follow through on returning the item so don't make it a habit.

What % do you think is fair? I was thinking 25% back of the original cost, is that too much-too little?

Ask for 100% back - it was a bait-and-switch. You need to get a full refund.

No, ask for a full refund. If you have to escalate it to ebay they don't do partial refunds so it's best just to go with the full refund.

I wouldn't close the case until you receive the new product.

DO NOT close the case without it being resolved - tell them you are happy to close it once it is resolved. Report them to ebay - it sounds like they are trying to scam you.

Do not close they case. Since they didn't offer the new set as a response in the case but instead via e-mail I would be very wary. Seller can offer other resolutions within eBay cases.

Absolutely do nothing until you have a new item in your hand. Sounds like they are well versed in how to fix feedback/opened case issues without really fixing the problem. The feedback and opened case are one of the few things legitimate buyers can use to force an unscrupulous seller into doing right. Use them.

Because of laws in place, it's much cheaper to ship from China than it is to ship to China. I would leave neutral feedback stating the stitch costume was not as pictured, but acceptable. That way you are warning others, but not creating a fuss over it since you want to keep the item.

On a future note, don't buy from China. I think they call them drop shippers or drop sellers. The ebay account holder is in America, and can answer your questions and deal with you in English, so it doesn't raise red flags. But the seller never actually sees the item they are selling. They get pictures from a manufacturer in China and list the item. When the item sells, they forward the order to China to be fulfilled.

I don't know if you actually meant e-mail or if you meant an eBay message, but the only thing I would add to the PP's advice is to ONLY communicate with the sellers via eBay messages, and once you have the case open you can communicate with them via your open case in the resolution center. That way eBay has full access to everything that is said between the two of you and they can look at the history.

I am a powerseller on ebay and agree with the PP's that your cookie cutter seller needs to resolve the problem in its entirety BEFORE you close the case. If you close the case you then have no recourse and they have no obligation to actually fix the issue after the fact.

I have heard nothing about the Stitch costume pajamas.

This was after replying that I would be happy to close the case when I receive the Mickey Cookie Cutter.
 
Get the refund first and then close the case. Sounds super fishy. I have only had one bad buying experience on eBay but EBay and PayPal quickly resolved it based on my in-eBay communication.

The bad broken English is something I don't like. I agree with an earlier poster to try not to buy things on Ebay from China sellers.
