Ebay problem - What should I do?

File the complaint today, before she moves all the money out of her account and you'll be SOL. If the dress comes before you leave you can decide then what to do, but the sooner you file the complaint the better.
 
Pretty much everything I wanted to say has been said. I would file the Paypal complaint NOW! She has missed the boat on many fronts:
-Required to ship the method that is stated in the auction. It is a contract.
-Must ship within 7 days of receiving payment
-Must have a tracking # if she wants to be covered by Paypal.

Plus all the other lies she has told you!

IF the package comes I would not open it. Write "Refused. Return to Sender" on the package and drop it back in the mail. It will be returned to her at no charge to you.

Did you use a credit card to pay through Paypal? If you file the complaint with Paypal and they don't return the money stating she has none in her account you can then file a dispute with your CC. They will credit you back the money and collect from Paypal. Paypal will then be stuck collecting from the seller. They seem to be much more motivated to get money when that happens:confused:. Also they will pass on the chargeback fee they get charged from the CC to the seller. She deserves it for all her lies!
 
Which she will provide! Paypal will say you got the dress, (they don't care WHEN) and you won't get your money.

Paypal's main concern is making sure Paypal got paid, not that you got what you paid for (which is why I am no longer on Ebay)

They actually follow up better than just any old tracking number..it has to have gone to buyers address, etc. I was actually impressed with Ebay/Paypal awhile back. My son sold an old reel to reel to a guy..he said it arrived broken, and he had already paid to have it fixed..yadayada, so filed a claim. Ebay/paypal agreed he had to send the item back to get a refund, so he sent a box with with an ENTIRELY DIFFERENT PLAYER in it. My son filed a co/complaint, and after viewing the pictures etc, sided with my son and the money stayed in his account. So..it can work out.
 
I'm not really sure where to post this one, but I figured the budget board might be the best spot.

What would you do?

We are going to Disney in 2 days! :banana: I bought my DD a VERY expensive - but discounted and used Belle deluxe princess dress for her BBB appt for her birthday. I paid over $70 for the dress and the shipping. I didn't even pay that much for her flower girl dress for our wedding, so this is a splurge. I bought it 3 weeks ago with a promise that it would ship priority mail and be here in about 5 business days. The seller knew when we were leaving and why we bought the dress, and assured us it would be here in time.

After not receiving it when I should have, I contacted the seller, and she said something came up and she shipped it a week late. Well, I still don't have it and I leave in 2 days. I contacted her again, and she said she had to send it parcel post b/c priority would have cost $40 to ship and I paid $10 for shipping. (I think this is a load of bull b/c parcel usually only saves a few $.)Because it's parcel post, there is no tracking number, and it can take over 2 more weeks to get here.

Basically, I spent all this money on something we are never going to use. I am keeping my fingers crossed that it might come on Monday, but I am doubtful. I am also furious!! :mad:
What would you do? Should I file a complaint? Do I get my DD another dress? I really didn't want to spend another $80 on a dress in Disney.

IF she listed Priority and her listing says, "will ship in 2 days" from cleared payment (and a check did not hold it up :confused3) and you can SEE the date she actually shipped it (and it is PAST that 2 days) you CAN contact ebay, dispute it and you will get refunded, and SHe will get her item back at her expense. Its all such drama and as a Seller I really think she is Awful to put you all thru this. What a nightmare. IF you get it in time and decide to just keep it, Please give her - feedback for Delayed ship by Seller so others will think twice. Personally I would also ask for a refund, parcel post is WAY cheaper than Priority...there is no UPcharging on EBay for sellers....Best of luck, hope it works out....:wizard:
 

Thanks for all the replies everyone. It makes me feel better to know that I'm not crazy for thinking that the seller is being crooked.

I think I am going to wait for the mail to come tomorrow and see if anything magically happens. If not, I will file all the complaints and leave negative feedback.

I buy a lot of stuff through ebay - b/c I'm cheap and we live in the boonies, and I have never had a problem like this.

And to answer the question about the price of the dress - this is one of those limited edition deluxe additions that cost about $150. I got it for less than 1/2. But it does make me wonder if she didn't have it to begin with - it wasn't a stock photo :confused3

Disney packs those things all folded up in a little tiny envelope, so I don't understand why she didn't do the same. Anyway, we'll see what happens.

Id like to also know if what she SOLD you is actually what you get????? Please let us know...........
 
Save all your emails between you and the seller. If it doesn't show up today then file with Paypal. If she hasn't given you the tracking number by now it's because she doesn't have it. I've sent a Belle dress in one of their flate rate boxes for $11. If it really was $40 then it's her own fault that she wasn't smarter at packaging.

Also if it does show up today - I'd ask the mailman to wait and open the box in front of him/her. That way you have an impartial set of eyes to confirm that she sent you what you bought. Or use a video camera showing the opening.
 
file a complaint with PayPal and then refuse delivery when it arrives. It will go back to her with no cost to you.
 
FYI, I actually sold that exact same dress on ebay over the weekend (NO I'm not your seller!!) When I boxed it and shipped it priority mail today, it weighed just over 2 lbs and cost $8.15 to ship with delivery confirmation from TN to MI. So, yes, $40 is ridiculous!
 
Well, crap. I subscribed to this thread hoping for a happy ending :(. Oh well, it'll be more fun for the OP's little princess to pick out a dress at WDW anyway. She will also be able to dress up in it and not treat it like a museum piece that will need to kept perfect for resale.
