EBay - Need Help with Buyer Please

You have the buyers address. Interstate fraud os a federal offense. I would actually see if you can file a police report in his local jurisdiction with their fraud department as well see how would handle such inter state fraud. This person is clearly a thief and needs to be reported to rhe authorities.

I don't know how close they live to you and if it would be worth it but I would look into filing a claim with small claims court. Mostly because it would tick me off that they are running this scam.

Hi all. Thank you again for all your help, I knew I would find the help I needed but ebay doesn't care, just like you told me.

I received the phone back and it, as we knew, is not my phone. So, the seller has my phone. As I let you all know, ebay had
sided with the buyer beginning of this week, even though he has done this before. There are negative comments left in his
positive comments as well as negative comments.

I left a negative comment for the buyer and I received a notice from ebay it was against policy...OMG! Are you kidding me!
I looked this morning and my comment has been removed, this just is crazy to me.

I asked ebay yesterday since I am out the money for the phone as well as MY phone and have a bogus phone back, is it
at all possible to please at least have my negative comment removed since it is a lie and the buyer has done this before.
When they said they couldn't do it, I asked to be transferred to the department that oversees these matters, they told me no.
I asked, as a poster suggested, to speak to a manager. The manager told me that this is the buyers opinion and they
will not remove the comment. I also told them to look at the ebay correspondence, where in an e-mail to me, he wrote hahahahaha
I about wanted to throw my phone out the window when ebay told me the negative comment stays.

Thank you to the poster that let me know how to respond to a negative comment, which I did. I appreciate it.

My rating went from about a 99 to 86. I don't even bother looking to purchase anything from anyone that doesn't have at
least a 98%, so I probably won't/can't sell any longer on ebay but I will look into Amazon as another poster suggested. I don't have facebook
and not sure if people sell on that too, but I do know they sell locally. I don't sell much but once in a while.

I deposited the money back into my account this morning on my way to work and will just refund the money that I received for my phone the seller has, ggrrrr.

Were you able to report the phone stolen?
It's hard because if I were you I'd want to go after him with anything I could like filing theft charges but I don't know how costly or practical that is.

EBay really needs to step up and start protecting people from scammers. If someone has multiple complaints they need to do something.
Not only did this person steal your phone but they ruined your chances at selling on eBay with the negative.

Hi. I sold two iphones on ebay. Both in excellent condition. They were kept in Outter Boxes and great working and looking condition.

I just had one buyer contact me and ebay saying they want a refund. The packaging was great and the phone packed good and no postal mishandling but that I sold him a Phone that was bent and very damaged.

He wants a refund and I am guessing if I did that I will be getting back not my phone.

Ebay has already taken money from my paypal (there was money in there today from a point rental for DVC) until the matter is resolved. I have never had any negative comments and he has left one but what I am more concerned about is the phone and money.

I guess in the morning I contact ebay but it really stinks since my dd just came back from school tonight for spring break and leaving for Italy tomorrow and we have a lot of running around to do in the morning.

Am I out of luck with the money and phone since I read on here ebay doesnt help buyers? He has had a few negative comments about doing the same stuff but with less costly items. If I knew I was getting my phone back I wouldnt care but it was my phone and always in a defender outterbox and really like new. It wasnt bent And cracked.

What do I need to please do.

Before you just give back the money, ask for pictures of the phone, front and back, also of the packing, to compare to your pictures. I had a lady insist that I sent her a damaged item, I could tell from the picture that she sent that it was not the item that I sent her. I contacted eBay and went through it with them, they will check feedback for both of you. You do not have to refund the money until the item is returned to you. She wanted me to refund the money and she thought she should get to keep the item. After a couple of weeks and a few calls to eBay they sided with me and I did not have to refund her money. I did get a nasty message from her and again I called eBay and they handled it.

Sorry to hear, OP. I was hoping for the best even though I expected the worst. The negative feedback is frustrating. I had a buyer leave me negative feedback once and I called eBay and they told me the same thing - that unless there is profanity or it's a provable lie, the feedback is the users opinion of the transaction. So that really sucks for you, I'm sorry.
