I’m putting together a rental agreement to rent points, and in a few of the samples I’ve seen verbiage similar to the following:

Renter agrees to abide by all Disney Vacation Club terms, policies and rules applicable to Disney Vacation Club owners and Disney Vacation Club membership

any pointers to where those terms etc may be? I haven’t been able to find other than once logged in to the dvc site.
 
You find that in rental agreements because the POS documents provide that rental agreements must include terms making the renters bound to the same rules for use of a room and resort as the members. To actually find all of the possible terms that might apply, you need to read through the POS documents, totaling about 200 pages.

However, those particularly pertinent to a rental would mainly be the Condominium Rules and Regulations, an exhibit to the Declarations, which provides the rule requiring rental agreements to include that term you see in the rental agreements. That exhibit also sets out various occupancy rules preventing pets, prohibiting building or hanging things on the balcony, or adding things to walls, etc.

Thanks drusba. Interesting... based on your explanation, I understand the legal reasoning behind including the statement in the rental agreement. Assuming not many renters would know what those terms are, and based on the amount of info one would have to go through in the POS, and lack of a way to easily get to the POS documents, there's probably no actual benefit in the renter [implicitly] agreeing to the statement.

Pointing me to the Public Offering Statement, did let me do some more google searching, and I found a couple of disney related sites that had some excerpts of the POS relating to rental etc.

And there is a benefit to the clause even though the renter does not see the applicable terms. He has agreed generally to them via the contract, and if he actually does something set out as improper on the Condo Rules while at the resort, he can be stopped from doing it while there and the excuse that he was not actually shown the applicable rule will not save him.
